It appears that disputes over the noise·vibration between residents of a multi family house, such as apartments, etc., resulting from the change in modern people’ lifestyle and the crowding of residential types, etc. are continuously increased. It is true that the pleasant and comfortable residential environments of residents have been already intruded into by various type of the living noises, specially the severe intrusion into a private life by the inter-floor noises occurred in a multi-family house which forms a residential community. Any dispute resolution means to protect effectively rights from such livingnoises, that is, the inter-floor noises which have no choice but to be inevitably occurred in a multi-family house, include various type of the relief of rights such as self-regulating dispute resolution using the rules on the management of multifamily house as said as the autonomous norms of a residential community; a penalty imposition under the Minor Offenses Act; the utilization of a mediation system in the Environmental Dispute Resolution Commission; and finally a claim for damages & a sustaining claim which are the civil relief process. However, in order to find a desirable solution plan about any inter-floor noise occurred in a multi-family house such apartments, etc., it is necessary first of all to avoid the transition of an inter-floor noise problem, which have no choice but to be occurred while a resident of a multi-family house leads a community life, to a legal dispute with which social expenses are accompanied and it is difficult to prove any damage facts. It shall be tried to resolve the inter-floor noise problem which are spreading recently to social problems by running parallel with both the cultivation of community spirit through the concession and consideration of multi-family housing residents and a governmental level of the multi-lateral interfloor noise countermeasure for the comfortable residential life of the multi-familyhousing residents so as to find a clue for the resolution of the inter-floor noise problem of a multi-family house which is going up to social complications.

현대인의 생활양식변화 및 거주형태의 밀집화 등을 원인으로 아파트 등 공동주택 거주자간의 소음·진동관련 분쟁이 지속적으로 증가하는 현상을 보이고 있다. 이러한 거주환경의 급격한 변화로 말미암아 거주자의 쾌적 하고 안락한 주거생활은 이미 각종 형태의 생활소음 특히, 거주공동체를 이루고 있는 공동주택에서 발생하는 층간소음으로부터 심각한 사생활의 침해를 받고 있는 것이 사실이다. 이와 같은 생활소음 즉, 공동주택에서 필연적으로 발생할 수밖에 없는 층간소음으로부터 효과적으로 생활이 익(환경이익)을 보호받기 위한 분쟁해결수단은 거주공동체의 자치규범이라고 할 수 있는 공동주택관리규약 을 이용한 자율적 분쟁해결, 경범죄처벌법에 따른 범칙금 부과, 환경분쟁조정위원회의 조정제도 활용, 마지막 으로 민사상의 구제절차인 손해배상청구와 유지청구(留止請求)와 같은 다양한 형태의 권리구제수단이 이용 되고 있다. 하지만 아파트 등 공동주택에서 발생하는 층간소음분쟁의 바람직한 해결방안을 모색하기 위해서는 우선 공동 주택 거주자가 공동생활을 영위하면서 발생할 수밖에 없는 층간소음문제를 사회적 비용이 수반되고, 피해사 실의 입증이 곤란한 법적 분쟁으로의 이행을 가급적 지양할 필요가 있다. 최근 사회적 문제로 파급되고 있는 층간소음문제는 공동주택 거주자간의 양보와 배려를 통한 공동체의식의 함양, 그리고 공동주택 거주자의 안 락한 주거생활을 위한 정부차원의 다각적인 층간소음대책이 병행됨으로써 사회적 갈등으로 치닫고 있는 공동 주택 층간소음문제 해결을 위한 실마리를 찾을 수 있을 것이다.
