This study examined the legislation movement by the Korean Women's Association regarding sexual violence and domestic violence from the 1990s, when special act for sexual violence and the act against domestic violence were first established through various revisions to the present, as sexual violence and domestic violence towards women is becoming frequent. Female violence, like other general violence, is one of the various types of violence in the social institutional framework and its institutional and structural violence is in its root. The legislation movement in the early 1990s was based on the change of state-movement politics and the female movement against the dictatorship actively utilized the institutional means in order to seek conflict cooperation with the state, which was an important change. However, in line with the target of legislation, it focused on ‘sexual autonomous decision’ rather than focusing on power of discrimination in relation to gender. Eventually, its strategy has become focused on the achievement of the goal by minimizing gender conflicts, which can be said to be a unique Korean phenomenon. Nonetheless, this does not identify with feminism which ignores numerous differences between women by simply focusing the cause of female suppression on a patriarchal system and sexual differences. Rather, they stress that feminism must encompass various differences. It became a fresh stimulation for many existing women groups to reflect their method of progression. Accordingly, the female movement in Korea encounters challenge in which they must review their sexual politics of women’s human rights and expand its discussion in depth. Based on such discussion, this study considers the direction of female movement against female violence and aims to get insight for the measurement against female violence.

본 연구는 최근 성폭력, 가정폭력 등과 같은 여성에 대한 폭력범죄가 빈번하게 발생하고 있는 현실에서 지금까지 여성폭력에 대하여 여성운동이 어떻게 대응을 해왔는지 그 과정을 짚어보기 위하여 1990년대 성폭력특별법과 가정폭력방지법을 제정할 당시부터 여러 차례 개정을 거친 오늘날까지 여성운동단체의 입법운동에 대하여 살펴보고자 한다. 여성폭력은 다른 일반적 폭력과 마찬가지로 본질을 살펴보면 사회의 제도적 틀에 있는 폭력의 다양한 형태 중 하나로 제도적, 구조적 폭력이 근원을 이루고 있다. 1990년대 초반의 입법운동의 배경에는 국가-운동정치의 변화가 자리 잡고 있으며, 과거 독재정권에 맞서 국가와 대립했던 여성운동이 제도적 수단들을 적극적으로 활용하면서 국가와의 갈등적 협력을 모색하게 된 것은 중요한 변화라고 할 수 있다. 그러나 법의 제정이라는 목표와 맞물려 젠더관계에 있어서 권력이나 차별을 쟁점화하기보다 ‘성적 자기결정권’ 에 초점을 맞추었다. 결국 젠더갈등을 최소화하면서 목표를 성취하는데 전략의 역점을 두었으며, 이는 지극히 한국적인 현상이라고 볼 수 있다. 하지만 그렇다고 해서 여성억압의 원인을 단순히 가부장제와 성적인 차이에 초점을 맞춤으로써 여성들 사이에 존재하는 수많은 차이를 무시하는 페미니즘을 동일시하는 것은 아니다. 이들은 오히려 여성주의가 여성들의 다양한 차이를 포용할 수 있어야 함을 강조한다. 이것은 기존의 여성단체들로 하여금 운동의 수행 방식을 되돌아보게 만드는 신선한 자극이 되었다. 따라서 한국의 여성운동은 이제 여성인권의 성정치학을 재점검하고 그 논의의 심화와 확장을 도모해야 하는 새로운 도전의 시기를 맞고 있다. 그리고 이러한 논의를 바탕으로 앞으로 여성폭력에 대하여 여성운동이 나아가야 할 방향을 고민해 봄으로써 여성폭력에 대한 대응책 마련에 도움을 얻고자 한다.
