The study on this Convention(CISG) which governs the international sale of goods in a uniform manner is more required than any other time. This study focused on the conformity of the goods which is regulated by the CISG. In addition, some of the cases, international or domestic, in which the issue concerning the CISG were raised and debated were also analyzed. The purpose of this paper is to examine the seller's obligations for fitness of goods to the contract under the CISG, except where both parties have agreed expressly, and to give suggestion in actual transactions. The provisions in the CISG on the conformity of goods with the contract are included in Article 35. Unless otherwise agreed between the parties to contracts for international sale of goods, the Article 35 stipulates four criteria to judge the fitness of the goods to contract: fitness for the ordinary purpose, fitness for any particular purpose, possession of the quality of sample or model and use of usual or protective container or package. The Article 35 also provides a exception for sellers against the lack of fitness: in case at the time of the conclusion of the contract the buyer knew or could not have been aware of such lack of fitness. Unless otherwise stipulated, the conformity should be judged when the risk possess to the buyer according to the Article 36. In reviewing decisions, common views of case law will be highlighted and divergent approach will also be presented. This would eventually facilitate the emergence of the uniform interpretation of CISG.

국제물품매매에서 매도인은 물질적인 측면 즉, 품질, 수량, 중량, 포장에 있어서 계약에 적합한 물품을 인도할 의무를 부담할 뿐만 아니라 권리적인 측면에서도 그 권리이행에 지장이 없는 계약물 품을 인도해야 할 의무를 부담한다. 그러나 당사자 간의 합의된 사항이 없는 경우, CISG에서는 적합성 결여의 기준을 구체적으로 제시하고 그 기준에 미치지 못하는 경우를 물품의 계약부적합성 으로 하여 매도인에게 하자담보책임을 지우고 있다. 본 논문에서는 국제물품매매에 대한 법 통일을 위하여 채택된 CISG상 규정되어 있는 계약물품 의 적합성 기준을 살펴보고, 적합한 물품을 인도해야하는 의무에 대해 고찰 하여 그러한 적합성 기준에 대해 구체적으로 논술하고자 하였다.
