First, the normative meaning of the period of participation in dividendscan be interpreted that being in harmony with the equality rule by givingweight to the principle of priority is corresponding to our constitutionaleconomic order, based on free competition and pursuit of social justice. Second, in the light of the importance of the normative function aboutthe protection of the rights of creditors, this paper pointes out the problemsof the provisions of existing laws and legislation, and proposes to enactlaws about them. This is closely related to the normative order on civilexecution system. Third, about the prolongation of the period of participation in dividendsfor the protection of the rights of creditors who did not observe the periodof participation in dividends or did not receive notice about it, SupremeCourt made decisions on some cases. Based on the prior research aboutthe extraction of the compared elements from those judgments, whenexamining whether to prolong the period of participation in dividends, thispaper proposes to do analogical application of the complements on theCode of Civil Procedure in the judgment of the Court. Fourth, by suggestion of the possibility about individual relief throughmaking the time of termination of participation in dividends in a real estateexecutive system as the peremptory term, this treatise insists on preventingthe inconsistent effect with the spirit of legislation which is caused by theprolongation of the period of participation in dividends. Finally, in the double auction, the opinion about determining the periodof participation in dividends of the following auction related with theinvalidation of the preceding auction is presented on this paper.

본 논문은 부동산집행상 배당요구 종기제도의 규범적 의미 및 관련된 문제들과 그에 대한 입법론을 중심적 내 용으로 다루고 있다. 첫째, 배당요구 종기제도의 규범적 의미에 대해서는 자유경쟁을 바탕으로사회적 정의를 추구하는 우리 헌법 상 경제질서와 부합하도록 채권자들 사이의 배당에서 우선주의적 효과의 발현을 통한 평등주의와의 조화에 있다고 해석하였다. 둘째, 채권자의 권리보호라는 규범적 기능의 중요성에 비추어 볼 때에,현행법규정의 문제점들을 지적하고 그 에 대한 입법론을 전개하였다. 이는 민사집행법 체계상 규범적 질서와도 깊은 관련이 있는 것이다. 셋째, 배당요구의 종기를 준수하지 못했거나 통지를 받지 못한 채권자의권리보호를 위한 배당요구종기의 연 기 여부에 관하여 대법원판례를 통해 비교형량의 요소들을 추출하는 선행의 연구를 바탕으로 하면서, 배당요 구종기의연기 여부를 검토할 때, 집행법원의 판단에서 민사소송법상 추후보완사유의유추적용을 제안하였다. 넷째, 부동산집행상 배당요구의 종기를 불변기간으로 입법화하여 개별적구제의 가능성을 제시하여, 배당요구 종기의 연기로 인하여 야기되는 입법취지에 배치되는 결과를 방지할 수 있음을 주장하였다. 끝으로, 이중경매에서 선행사건의 실효에 따른 후행사건의 배당요구의 종기결정에 관한 의견을 개진하였다.
