As Dokdo dominium jurisdiction is a matter of international law, legal study until now was centered on international law related studies, and domestic law related studies were relatively small. In case of ownership in domestic law, it concerns private rights. However, in certain cases, national land can even be a target of jurisdiction between the state's ownership and national agency. In this sense, whether Dokdo is a state-owned land or private land as well as the matter of ownership and occupation of the land can be problematic. Also, the government shows the determination to plan and put forward the reinforcement project of effective possession of Dokdo. There is a sufficient possibility of problems related to private right of Dokdo if the government increases building structure and facilities as reinforcement approach for effective possession of Dokdo. In case of occurrence of right that is subject to jurisdiction in Dokdo, or if a foreigner acquires it from an individual who transfers it to him, international problem might occur because of the uniqueness of Dokdo's historical and geographical characteristics. In this case, it is possible that a foreigner, including Japanese acquire ownership or occupation based on the principle of reciprocity. Of course, this possibility is small under the current law, and it can even be impossible. However, even if a foreigner acquires the private right at any time in the future, it can be restricted for the purpose of Dokdo management and administration. However, in case of failing to legally restrict acquisition of foreigner or to forbid transferring the right to foreigner or to prepare a legislation limiting only the Japanese from the right of using, of profit and of disposal, there is no way to prevent it. Therefore, from the beginning, an individual should only be given the right of using and of profit, not the authority to dispose, and it is necessary to even limit the right of using and of profit as well in some cases. Hence, it is necessary to enact legislation.

독도 영유권의 귀속은 국제법적 사안이므로, 지금까지의 법적 연구가 국제법 관 계 연구를 중심으로 이뤄졌고, 국내법 관계 연구는 상대적으로 소홀한 것도 사실 이다. 국내법 관계의 소유권과 같은 경우는 사권을 그 대상으로 하지만, 특정한 경우에는 국유지도 국가의 소유권이나 국가기관 사이의 사법관계의 대상이 되고 있다. 이 점에서 독도가 국유지인지 사유지인지의 문제뿐만 아니라 국유지 소유자 관계 및 국유지 점유관계도 문제된다. 또한 정부는 독도의 실효적 지배 강화사업을 대규모적으로 계획ㆍ추진하겠다는 의지를 보이고 있다. 정부가 독도에서 실효적 지배의 강화방안으로 시설물이나 건축 물의 설치를 증가시킬 경우 독도에서의 사권관계가 발생할 가능성은 충분이 있다. 즉, 앞으로 독도가 이용ㆍ개발이 되고 어떤 방법으로든 거주 인구가 많아지게 되 면 자연적으로 민간인에게 불하되는 건물, 시설물이 발생할 가능성 있다. 독도에 서 사법의 대상이 되는 권리가 발생할 경우나 이를 개인이 취득하여 외국인에게 양도하여 외국인이 이를 취득하게 될 경우, 독도의 역사적ㆍ지역적 특수성으로 인 하여 예상치 못한 국제문제가 발생할 가능성도 존재한다. 이 경우 상호주의 원칙 상 토지를 포함하여 개인소유나 점유 부분에 대하여 일본인을 포함하는 외국인 이 취득할 소지가 있다고 본다. 물론 현행법 하에서는 그 가능성은 낮다고 보며, 전혀 없을 수도 있다. 다만, 이 부분에 대하여는 미래 어느 때 외국인이 사권을 취득하더라도 독도관리나 행정목적상 제한될 수도 있다고 본다. 그러나 개인이 독도에서의 권리를 취득하더라도 특별법에 의하여 외국인의 취득을 제한하는 입법을 마련하거나 또는 계약상 외국인에게 양도를 금지하는 특별규정을 두거나, 혹은 일본인만을 대상으로 하여 그 사용ㆍ수익ㆍ처분을 제한하는 입 법을 두지 않을 경우 사실상 이를 막을 방법이 없다. 그러므로 처음부터 개인에게 사용ㆍ수익권만 주고, 처분권을 주지 말아야 하는 국내입법이 필요하며, 사용ㆍ수익 권도 일정한 경우 제한할 필요성이 존재한다. 따라서 그에 대한 대비책으로 입법 제정의 필요성이 존재한다.
