The Critical Theory is now represented by the discourse ethics. The discourse ethics follows the line of the thoughts of the so called first generation of the critical theory and finds the ground of the re-enlightenment in the constant formal structure of the daily speech actions. It can satisfy the two required conditions for the establishment of the morality. That is, it can, on the one hand, establish the morality without any help of the metaphysical thought and it can, on the other hand, escape the danger of the relativism. In other words, it can provide the ground of the morality not with the particular social practices but on the universal communicative actions of all the persons. However, it immediately gives rise to the different evaluation of the post- metaphysical moral theory. It implies that it neglects the ethical dimension. If the criticism is fixed, the discourse ethics can not help being the theory which is devoid of the ethical dimension. It means that the tradition of the critical theory is involved in the theoretical problem situation. This article deals with the problem situation for the sake of the development of the critical theory.

비판이론은 현재 담론윤리로 대표되고 있다. 담론윤리는 비판이론을 계승함에 있어서 비판이론의 소위 제 일 세 대가 시도했던 계몽에 대한 계몽을 이어나가면서 그러나 그 재(再)계몽의 근거를 생활세계의 일상적 언어활동의 불변적인 형식적 구조에서 찾는다. 이를 통해 담론윤리는 도덕성을 정립하는데 요구되는 요건 두 가지를 동시에 충족시키게 된다. 곧 담론윤리는 한편으로 도덕성을 형이상학적인 사유로부터 독립시켜 그 자체로 성립시키면 서 동시에 다른 한편으로 그럴 경우 발생할 수 있는 상대주의의 위험에 빠지지 않을 수 있다. 다시 말해 담론윤리 는 도덕성의 근거를 특수한 사회 관습이 아니라 모든 인간이 자기이해를 확인하는 보편적 의사소통 행위 상황에 서 마련할 수 있다. 그런데 이렇게 탈-형이상학적 도덕이론의 전망을 연 담론윤리에 곧바로 이와는 사뭇 다른 평 가가 내려진다. 곧 담론윤리는 윤리적 차원을 소홀히 하게 된다는 것이 그것이다. 만일 이와 같은 비판적 평가가 그대로 고착화된다면 담론윤리는 그 제목이 시사하는 것과는 달리 윤리적인 것 - 삶 - 과 괴리되는 이론으로 간 주될 수밖에 없게 된다. 이는 상당히 중요한 결함이 비판이론의 현재 모습에 발생하는 것이며 이는 진지한 논의 를 요하는 중대한 상황이 벌어진 것이라고 할 수 있다. 이 같은 비판적 상황을 비판이론의 발전의 계기로 고찰하 기 위해 이 글을 쓰여 졌다.
