This articles aimed at analyzing the disputes between the Korean Trade Insurance Institute and negotiating bank, explore the practical problems and present the defending measure in that cases. The main issues in that cases are non-documentary conditions special or add conditions in the credit, fraud rule application, and the liability of negotiating bank’s documents examination etc. The two cases in this article generally deal with negotiating bank’s documents examination under L/C transaction. A negotiating bank request the reimbursement claim to the Korean Trade Insurance Institute but they refused to make payment of insurance money to the claimer because the negotiating bank negotiated the non- complaint documents and broke the exemption clause under their insurance contract. The Korean court which deal with the same cases sentenced the same as above results. So, We concluded that the negotiating bank must take much more care of examining the presented documents and put much more intention to control their customer.

본 논문은 국내 무역보험공사와 선적서류 매입은행 간 수출보증서에 의한 보증금 상환청구에 대한 사례를 취급한 논문이다. 매입은행은 신용장 조건상 수입자가 발행한 지급증명서 또는 제품확인증명서의 제출을 요구한 부가 조건을 비서류적 조건으로 보고심사의무를 소홀히 한 사건으로서 무역보험공사에서는 이를 신용장거래의 조건위반으로 보고 보증금 상환 청구를 거절하였다. 본 논문에서는 법원의 이러한 판결이 너무 법 논리적인 판단으로서 실무적인 관행을 무시한 판단이었음을 지적하였다.
