Food safety is the top priority concern of the world consumers as well as Korea. As personal incomes and concerns for pursuing wellbeing are increasing, desires of safe food stuffs are increasing. On the other hand, some suspicions on safety of newly appearing GMO food still remain. Food interchanges between countries have increased steadily, but environments to be able to secure food safety are in unsatisfactory conditions. So, food safety accidents occur incessantly. Korea early has endeavored to secure food safe. Food Sanitation Act and Food Safety Law were enacted and have been implemented. Lee Myung-bak regime made ‘realization of a safe developed country’ as promotion work and adopted food safety as one of 100 government projects. Also, Park Geun-hye administration picks elimination of illegal food as one of four evils’ eradication. Like these, securement of food safety is one of national first policy goals. As one of the national food security measures, it is necessary to look into food administration organizations and systems of food safety legislations. Since Korea’s food administration organizations and systems of food safety legislation are distributed into several places, there are difficulties in operating food safety policies effectively. namely, because Korea’s food safety systems were distributed into several departments according to 28 related statutes, effective policies could not be promoted. Also, the fact that the food safety commission under the food safety law does not have its function shows consecutive food accidents. This paper examined Korea and Europe’s food administration organizations and systems of food safety laws. Also, by deducting implications of EU’s food safety policies, improvement plans of Korea’s food administration organizations and food safety laws try to be suggested.

식품안전은 한국뿐만 아니라 전 세계 소비자의 최우선 관심사이다. 개인소득의 증가와 웰빙추구에 대한 관심이 증대됨에 따라 안전한 먹을거리에 대한 욕구는 증대되고 있는데 반해, 새로이 출현하는 유전자재조합식품 등의 안전성에 대한 의혹은 여전히 남아있다. 나아가 국가 간의 식품교역은 꾸준히 증가하고 있지만, 식품안전을 담 보할 수 있는 환경은 아직 미흡한 실정이다. 그래서 식품안전사고는 끊임없이 발생하고 있다. 한국은 식품안전을 확보하기 위한 정책을 꾸준히 시행해왔다. 먼저 식품위생법과 식품안전기본법을 제정하여 시행해 오고 있으며, 이명박 정부에서는 ‘안전 선진국 실현’을 추진과제로 삼고 식품안전을 100대 국정과제로 채 택하였다. 또한 현정부에서도 4대악 근절 중의 하나로 불량식품 추방을 들고 있다. 이처럼 식품안전의 확보는 국가의 일차적인 정책 목표 중 가장 중요한 요소이다. 이러한 국가의 식품안전 확보를 위한 방편의 하나로 식품 행정조직과 식품안전법제의 체계를 먼저 살펴볼 필요가 있다. 한국의 식품행정조직과 식품안전법제는 여러 기관에 분산되어 시행해오고 있어, 식품안전정책을 효율적으로 운 영하는데 어려움을 겪고 있다. 이것은 한국의 식품안전관리체계가 28여개의 관련법령별로 여러 부처에 분산되 어 있어, 효율적으로 정책을 추진하지 못했기 때문이다. 또한 식품안전기본법상의 식품안전정책위원회도 제기 능을 다하지 못하고 있는 것도 식품사고가 계속 발생하고 있다는 사실을 보여주고 있다. 한편, 유럽은 광우병 파 동으로 기존 식품안전체계에 대한 신뢰가 급격히 무너짐으로써 식품행정조직 개편에 대한 필요성이 요구되었다 . 그 결과 EU 회원국들 간의 식품위생에 관한 사항을 공동으로 대처해왔고, 이를 계기로 유럽식품안전청을 출범 시키면서 유럽위원회에 책임감과 일관성 있는 식품안전 정책을 수립하고 집행할 수 있도록 하였다. 이 논문은 식품안전의 확보를 위하여 효율성과 실효성의 제고라는 관점에서 한국과 유럽의 식품행정조직과 식 품안전법제의 체계의 현황을 각각 살펴보았다. 또한 유럽의 식품안전관리체계에 대한 시사점을 도출하여 한국 의 식품행정조직과 식품안전법제의 개선방안을 제시하고자 한다.
