This work intends to study some issues in relation to the documents lost in transit under the UCP 600 Article 35. Those issues include the contents and requirements of the documents lost in transit and practical measures by concerned banks. The purpose of the Article 35 is to protect a beneficiary and a nominated bank who has fulfilled his obligations to take proceeds under the letter of credit. This Article 35 has been based to some extent on the content of ICC Opinion R.548. Next, the requirements of the documents lost in transit include the compliance decision with the conditions of the letter of credit by a nominated bank, forwarding the documents to an issuing bank or a confirming bank(if any) by the nominated bank, the documents lost in transit, and satisfying the methods and manners directed in the letter of credit. Concerned banks in relation to the documents lost in transit are an issuing bank, a nominated bank, and a confirming bank(if any). A non-nominated bank will not be protected under the Article 35. It is very essential for concerned banks to cooperate one another when the documents lose in transit.

본고는 UCP 600 제35조의 우송 중 서류분실의 내용 및 적용요건과 관계 당사자의 실무 대응을 검토하였다. 먼 저 우송 중 서류분실의 내용은 UCP 600 제35조 제2문에 명시되어 있는데. 동 조문은 UCP 600에 새로이 추가 된 조항으로서 신용장 하에서 제시된 서류가 송부 도중 분실된 경우 지정은행 그리고 간접적으로는 수익자를 보호해주고 있다. 또한 우송 중 서류분실의 적용 요건으로는 지정은행에 의한 제시의 신용장 조건과의 일치 결정, 제시된 서류의 신용장조건과의 일치, 지정은행이 서류를 개설은행 또는 확인은행에게 송부, 송부된 서 류가 우송 중에 분실, 신용장이 지시하는 방법과 수단에 따른 송부 이행이 필요하다. 다음으로 관계 당사자의 실무 대응은 개설은행, 지정은행, 확인은행의 실무 대응으로 구분할 수 있다. 개설은 행의 실무 대응은 신용장 개설 시, 서류분실 판명 시, 서류 심사 시로 구분하여 대응가능하며, 지정은행의 실 무 대응은 서류 접수 시, 서류 분실 판명 시로 구분하여 대응가능하며, 확인은행의 실무 대응은 확인은행 외에 지정은행을 지정하고 있는 경우와 지정하고 있지 않는 경우로 구분하여 고찰한다.
