One of the most troubling developments of our society in recent days is the rapid increase in criminal and antisocial behaviors. In order to study legal consciousness and deviations of adolescents, this paper intends to approach the subject within the frameworks of two legal socialization theories-the developmental theory of legal consciousness, and the social learning theory. This study seeks to not only suggest deviance-preventive and legal educational implications, but also to shed light on thoughts on adolescence delinquency in different countries including Singapore, Mexico, and the United States, which in itself seems to be a valuable attempt. In the light of these findings, it can be surmised that Korean adolescents in general are negative in their outlook towards the fairness and justice of the law. Their knowledge of and confidence in the law were equally discouraging. These striking phenomena suggest that Korean adolescents are influenced by their elders’ less-than-exemplary behaviors and cynical attitudes toward law-abidance. Furthermore, they are indicative of the malfunctioning of our current school education system, which consistently fails to inculcate in them moral values and respectable personalities. Therefore, it is imperative that our national and judicial authorities earnestly establish legal order through exemplary law enforcement, and our educational scenes on their part develop various programs that can help foster firm legal consciousness.

오늘날 우리사회에는 범죄를 비롯한 각종 반사회적 행위나 일탈이 만연하고 있 다. 범죄를 예방하고 안전한 사회를 만들기 위해서는 인성함양과 아울러 법의식을 바로세우는 것이 우선적으로 필요하다. 청소년들의 법의식과 비행을 알아 보기 위 해 본 조사에서는 법사회화에 관한 두가지 이론적 접근으로부터 시작하고자 한다. 하나는 법인지발달이론이고, 다른 하나는 사회학습이론이다. 법인지발달이론은 Kohlberg (1986)의 도덕발달이론을 적용한 것인데, 이는 Piaget(1932)의 인지발달론으로부터 비롯되었다. 사회학습이론에는 다양한 견해들이 있지만 기본적으로 사회환경내에서 유인 혹은 강화 조건들이 직접적으로든지 아니면, 자기조절(self-regulation)과정을 통해서든지 행위를 통제한다는 관념을 공유한다. 논문의 결과를 통해서 볼 때 한국청소년의 경우 법의 형평성이나 공정성에 대하 여 부정적인 인식이 상당히 높았으며, 법에 대한 지식이나 태도 등이 대체적으로 나 쁘게 나타났다고 할 수 있다. 이러한 결과 즉, 법에 대한 부정적인 의식을 가지고 있는 이유는 어른들의 법준수의식과 모범적이지 못한 행동에도 그 영향을 크다고 할 수 있으며, 학교에서도 인성함양과 도덕교육과 더불어 법교육을 체계적으로 시키 지못하고 있는 현실을 반영하고 있다고 생각한다. 따라서 국가와 사법당국의 법질 서확립에 대한 확고한 의지와 모범적인 법집행과 아우러 학교현장에서 법의식을 함 양할 수 있는 다양한 교육프로그램이 준비되어야 한다고 생각한다.
