Modern private security is the result from the ideological combination of the capitalism and the industry. The general services or goods which are delivered by the private security have the characters of public security services in some degree; It is different from the other private services or goods. For this reason the national regulations to the private security are more demanded. However, when we reflect the history of the private security, it have committed unlawful violations especially in the labor dispute for the profit. In fact, it is very difficult to grope the proper harmony between the self regulating operations and the national regulations to the profit oriented enterprise in essentially. When we emphasize the former, the problem of violation of human rights can be occurred. And emphasize the latter the problem of economic stagnation of private security can be created. Therefore, in this situation, the way to find the harmony of the former and the latter of private security is very important. For this, first we must reset the private security in the nation's position and the role of the police, seek to the cooperation between the private security and the police. Second, the change of recognition and the practice of its based for the self regulation are needed. And it is very important to reinforce of regulation to the violations of the private security; at the same time the improper law related the private security must be protested by the related people. Finally, the change of national and social recognitions about the labor environments (especially, the very low salary of the private security personnel) muse be done.

현대의 민간경비는 ‘자본주의’(Capitalism)와 ‘산업’(Industry)이라는 관념이 결합하여 나타난 것이라 할 수 있다. 이러한 민간경비가 제공하는 제반활동은 일종의 ‘치안서비스’로서 다른 민간서비스나 재화와는 그 성격에서 차이가 있고, 따라서 상당한 수준의 국가적 규제가 요구된다. 그런데, 민간경비의 성장과정을 보면, 이윤추구를 위해 노동쟁의 등에 개입하여 불법적인 폭력을 자행해온 부분도 없지 않다. 사실, 영리를 본질로 하는 민간경비의 ‘자율적 운영’(自律的 運營)과 이에 대한 ‘국가적 규제’(國家的 規制)에 있어서 적절한 조화를 모색하는 것은 쉬운 일이 아니라고 본다. 민간경비의 자율적 운영을 강조하다 보면, 이로 인한 인권침해 등의 우려가 있고, 규제를 강조하다 보면, 민간경비의 시장경제가 위축되어 제기능을 하지 못할 우려가 있기 때문이다. 따라서 현재의 시점에서 민간경비의 자율적 운영과 적절한 규제를 모색할 수 있는 방법을 강구하는 것은 매우 중요하다고 본다. 이를 위해서 첫째, 국가차원에서 민간경비를 재정비하고, 아울러 관리감독기관인 경찰의 역할재정립과 민간경비와의 상호협력증진을 도모할 필요가 있다고 본다. 둘째, 민간경비 스스로가 자율규제 할 수 있는 인식전환과 실천적 자세가 요구된다. 그리고 민간경비의 불법행위에 대한 국가의 규제강화는 매우 중요하지만, 절차적 민주주의와 민간경비의 시장현실을 고려하지 못한 부분에 대해서는 민간경비 스스로가 문제제기를 해야 한다고 본다. 끝으로 민간경비에 대한 국가적․사회적 인식전환은 가장 본질적으로 이루어져야 한다. 민간경비에 대한 낮은 인식수준과 이로 인한 경비원들의 열악한 근무여건(특히, 급여체계)으로 인해 민간경비의 악순환은 반복될 수밖에 없기 때문이다.
