Private investigation business is the service industry to receive compensation defined in contract to investigate related fact and collect and analyze the related information according to the request of client in the private sector where the effect of public power is weak. Although private investigation business is not legalized in Korea and it is not legally admitted, it has been significantly developed as an important work of private security area in advanced country. The study researched the main work and scope of private investigation business that is performed under the table. The study results are as follows. First, the main work of private investigation business that is performed under the table is categorized into the case that is not covered by police 22(34.9%), personal investigation 16(25.3%), adultery 15(23.8%) and people search 10(15.8%). Second, if the work scope of private investigation business is set in the future legalization step, it will be the area that is not covered by public power 44(50.5%), non-criminal area 21(24.1%), the area requested by demander 17(19.5%) and the area due to invasion of privacy5(5.7%) 5(5.7%). The result of researching the main works of private investigation business that is performed under the table and work scope of private investigation business that should be set in the future legalization step revealed that the most frequent work of current main works is the case that is not covered by police. In addition, the main work scopes that should be considered in the legalization step related to private investigation business should be extended to the work that is not covered by public power. Because the main works of private investigation business are closely related to the limit of police and are significant man variables so they should be significantly considered in the future legalization process.

민간조사업은 공권력이 효력이 미흡한 민간영역에서 특정한 의뢰인의 요청에 따라 계약에 의해 보수를 받고 그와 관계된 사실관계를 조사하며 관련 정보를 수집ㆍ분석하여 제공하는 서비스업이다. 민간조사업은 현재 우리나라에서는 법제화되지 않아 합법적으로 인정되고 있지 않지만, 선진국에서는 이미 민영보안 영역의 중요한 업무로서 상당히 발전되고 있는 업무이다. 이 연구에서는 국내에서 음성적으로 이루어지고 있는 민간조사업체의 주요업무와 범위에 대하여 살펴보았다. 이에 따른 연구결과는 다음과 같다. 첫째, 현재 음성적으로 이루어지고 있는 민간조사업체의 주요업무는 경찰력한계 사건 22(34.9%), 개인조사 16(25.3%), 불륜현장 15(23.8%), 사람찾기 10(15.8%)으로 범주화 되었다. 둘째, 앞으로 입법화 단계에서 민간조사의 업무범위를 설정하여 본다면 공권력한계에 따른 영역 44(50.5%), 비범죄 영역 21(24.1%), 수요자의 요구에 따른 영역 17(19.5%), 사생활침해에 따른 영역 5(5.7%)로 나타났다. 현재 음성적으로 이루어지고 있는 민간조사업체의 주요업무와 앞으로 입법화 단계에서 설정해야 할 민간조사업체의 업무범위에 대하여 살펴본 결과 현재의 주요업무에서 가장 높은 빈도를 차지하고 있는 업무는 경찰력한계 사건이다. 그리고 민간조사업관련 입법화 단계에서 고려해야할 주요 업무범위 또한 공권력의 한계에 따른 업무범위로 그 영역을 설정하는 것이 이상적이라 하겠다. 민간조사의 주요업무는 경찰력의 한계와 밀접한 관계가 있으며 영향을 미치는 주요 변수이므로 앞으로 입법화 과정에서도 비중 있게 고려되어야 할 것이다.
