A today’s discussion of economic democracy is started by politicians at the last election. Although economic democracy was amended in the current constitutional law of 1987, it has been continued as the spirit of the constitution from the first constitution. The ideological background of economic democracy is founded by the inherent vice of capitalism, e.g. the unequal sharing of blessings and the social inequalities according to the monopolistic structure. The meaning of the term of economic democracy is focused on the division of economic powers. Namely, that has the inherent conflict structure between economy and democracy. Our constitutional provisions of economic democracy are specified the diversification of economic decision. And the contents of economic democracy are the marketism, the prevention of economic powers, the concentration of economic powers, the overcome of polarization and the rule of law in economic area. These institutions may be operated within the limits of Article 37 subsection 2 of the constitution.

오늘날 회자되고 있는 경제민주화 논의는 지난 선거를 전후하여 정치권에 의해 촉발된 것으로 1987년에 개정된 현행헌법에서 처음으로 수용된 개념이지만 그 정신은 제헌헌법이래 이어져 오 고 있다. 경제민주화의 이념적 배경은 자본주의의 폐해인 부의 편재현상이나 독과점의 출현에서 기인하는 사회적 갈등과 민주화의 급속한 진행에서 찾을 수 있다. 경제민주화의 개념은 조어의 구성으로 볼 때 경제권력의 분산에 초점이 맞춰져 있으며, 그런 점에서 개념내재적 갈등구조를 안고 있다. 우리 헌법에 규정된 ‘경제민주화’의 직접적 내용은 경제적 결정권의 다변화가 본질적 내용이다. 광범위한 간접적인 내용으로는 ‘시장의 지배와 경제력의 집중 및 방지’와 ‘양극화 해 소’ 그리고 경제영역의 법치를 들 수 있다. 이를 위한 각종 제도는 당연히 헌법 제37조 제2항이 정하는 바의 한계 내에서 가능하다.
