The jurisdiction of the police in Canada is largely distributed over federal, state and local governments obviously in terms of law and its rights and boundaries are clear. Nevertheless, the Canadian federal police (RCMP) maintains a unique police system that holds the contract system of the state police and local police while holding the position of the federal police at the same time. This police system model is one of the pretty unique cases when compared to so-called Anglo-American Law countries around Europe, UK, and USA. Even though UK, USA, and Canada are stemmed from same ancestors, they seem to have very different police systems each other. Especially in the most of the states in Canada, cities or towns which hold a constant population through legislation are obliged to manage their own police force. Of course they sometimes share local police force with neighboring local governments in accordance with law. However, most of the local governments in Canada tend not to install their own police force in tradition and cultural point of view so far. In other words, almost all states except Ontario and Quebec maintain their own police force through less-expensive federal police system or contact system with the state police. In Canada, even though operations of each state unit and base unit are completely decentralized, the police operation tends to be consigned to the federal police or state police to lessen the financial burden. This shows that there is no problem in maintaining local public order only through police consignment contract. Furthermore, the Canadian municipal police model can act as a positive factor that significantly relieves financial problems of the inequalities in municipal units; the capable municipal unit manages its own state police while incapable one consigns it to the contract police system so that it doesn't only build its firm foundation but also settles into its own unique municipal police model stemmed from long police history of keeping peace and order. In Korea, the introduction of municipal police system has been publicized for years, and the hot issue that appeared in preparation for its implementation was about the way to secure its budget. In this regard, Canadian municipal police system shown above has many implications for Korean local government in the poor financial status to introduces the municipal police system.

캐나다에서 경찰의 관할권은 크게 연방정부, 주정부, 지방자치단체에 법적으 로 분명하게 배분되어 있으며 그 권한과 경계가 명확하다. 그럼에도 불구하고 캐나다 연방경찰(RCMP)은 분명 연방경찰의 지위를 보유하면서 계약에 의해 주 경찰과 지역경찰을 갖고 있는 지구상의 독특한 경찰제도를 유지하고 있음을 알 수 있다. 이러한 경찰제도 모형은 유럽의 대륙법계나 영국이나 미국을 중심으로 한 이른바 영․미법계 국가들을 모두 합쳐 보았을 때 굉장히 독특한 케이스에 해 당되고 있다. 영국, 미국, 캐나다가 같은 영국민족임에도 불구하고 이들 상호간 에 각자가 전혀 다른 경찰제도를 활용하고 있음을 알 수 있다. 특히 캐나다에서 대부분의 주들은 입법을 통해 일정한 인구를 가진 시(City)나 군(Town) 지역들 이 스스로 자신의 경찰조직을 유지해야 하는 의무를 지고 있다. 물론 이들은 법 에 따라 인접 자치단체와도 필요시에는 상호 연합하여 지역경찰조직을 공유하는 경우도 어렵지 않게 찾아 볼 수 있다. 특히 캐나다에서 대부분의 지방자치단 체들은 그동안의 전통과 문화적 차원에서 볼 때 경찰조직을 스스로 설치하지 않 는 경향이 강한 편이다. 즉 온타리오(Ontario)주와 퀘벡(Quebec)주를 제외하고 거의 모든 주들이 비용이 적게 들어가는 연방경찰이나 주경찰과의 계약방식을 통해 자기 지역의 경찰력을 유지해 나가고 있는 실정이다. 부언하면 캐나다에서는 주단위와 기초단위의 행정권이 완전하게 분권화 되어 운영됨에도 불구하고 경찰의 운영만큼은 연방경찰이나 주경찰에 위탁하고 재정 부담도 줄이고 있다. 캐나다에서 이러한 경찰조직 운영방식은 경찰권 위탁계약 으로도 지역내 치안질서 유지에 아무런 문제가 없다는 것을 말해주는 것이다. 나아가서 이러한 캐나다의 자치경찰모형은 자치단체별 재정의 격차로 인한 치 안서비스의 불평등 문제도 상당히 해소해 주는 긍정요인으로도 작용할 수 있다 고 본다. 스스로 능력이 되는 자치단체는 스스로 주경찰을 창설해 운영하고 있 고, 반대로 그것이 어려운 지역의 지방자치단체는 계약경찰제도에 맡겨 그 토대 를 굳건히 구축한 캐나다의 자치경찰제도는 그들 스스로의 오랜 경찰역사와 치 안질서 문화가 낳은 그들만의 독특한 자치경찰모형으로 자리잡게 되었다. 수년전부터 한국에서도 자치경찰제의 도입이 본격적으로 공론화 되어왔으며 그 시행을 준비하면서 가장 이슈로 등장한 것이 바로 예산을 어떻게 확보하느냐 이다. 특히 열악한 재정을 가지고 있는 우리나라 지방자치단체들이 자치경찰제 를 도입하는데 있어 위에서 살펴본 캐나다의 자치경찰제 모형은 많은 시사점을 던져주고 있다.
