We need to innovate the process of the bill deliberation and improve the legislation techniques to reform the legislation which is the major function of the National Assembly. Lately the members of the Nation Assembly have introduced abundant legislative bills to its committees. However, what is more important is the quality rather than the quantity of bills submitted. It is also one of functions of the National Assembly to improve the bills brought in by the Korean Government through the thorough deliberation process. Legislative Studies are very practical sciences which deal with the legislative policy and its process as well as legislative theories and legislative skills. In Korea, however, legislative studies remain in the rudimentary stage. So we cannot expect its academic achievements thus far to contribute much to reforming the legislation of the National Assembly right now. Legislative Studies of Korea until now focused on the legislative skills practiced in Ministry of Government Legislation and National Assembly Secretariat which take charge of actual affairs of legislation. Recently Constitution Court of Korea contributed to the development of legislative studies by controlling the process and contents of legislation according to the Constitutional principles; Korea Legislative Research Institute also produced brilliant achievements in the legislation areas such as drafting of bills, systematic arrangement of legislation techniques, and the legislation assessment; and Korean Society of Legislation Studies contributed to the development of legislation studies in theoretical perspective. Their general outcomes, however, could be said to be slight as yet. In the future, National Assembly Research Service need to play an important role in developing legislation studies practically. To reform the National Assembly legislation, we need to fulfill the tasks as following: we should expand the legislation information to enrich the substance of the law drafting and deliberation of members of the National Assembly; we should ensure the quality of the member legislation by applying stricter requirements in introducing new bills; we should facilitate the adjustment of the conflicts among interested parts by improving the processes for the deliberation and resolution of legislative bills; we should establish the conditions under which the supporting organs of the National Assembly can give full play to their ability, and should improve the organizational structure to ensure it; we should continue the efforts to develop and use legislative techniques.

국회의 핵심기능인 입법사무를 혁신하기 위하여서는 심의과정의 혁신과 심의기 법의 개선에 있다. 최근 국회에서는 의원들의 법률안 제안이 활발하지만 법률안을 제안하는 것이 중요한 것이 아니라 제대로 된 법률안을 제안하는 것이 중요하고 정부제안 법률안 을 잘 심의하여 좋은 내용으로 다듬는 것이 국회의 할 일이다. 입법학은 입법이론과 입법기술 외에 입법정책과 입법과정을 다루는 학문이고 실 용성이 높은 학문인데 우리나라에서 입법학은 아직 초보단계에 머물러 입법학의 학 문적 성과가 당장 국회입법의 혁신에 기여할 것으로 기대할 수는 없다. 우리나라에서 입법학은 주로 입안심사에 관한 실무를 담당하는 법제처와 국회사 무처에서 입법기술 위주로 다루었으며 최근 헌법재판소의 입법절차에 대한 통제와 입법내용에 대한 통제도 입법학의 발전에 기여하였고 한국법제연구원도 법률안의 입안과 입법기술의 체계적 정리 및 입법평가 부문에서 업적을 쌓고 있으며 한국입 법학회는 이론적 관점에서 입법학의 발전에 이바지하고 있으나 전반적인 성과는 미 미한 편이다. 앞으로 국회입법조사처에서 입법학을 실무적으로 발전시키는 역할을 담당할 필 요가 있다. 국회입법의 혁신을 위한 과제로서는 의원들의 법률안 입안과 심사의 내실을 기 하기 위한 입법정보를 확충하고, 의원입법 발의요건을 강화하여 의원입법의 질적 수준을 확보하며, 국회의 법률안 심의의결절차를 개선하여 이해관계자의 갈등을 조 정하고, 국회입법지원조직의 역량을 최고로 발휘할 여건을 조성하고 이를 위한 조 직개선을 도모하며,입법기술을 개발하여 활용하는 노력을 계속하는 것이다.
