Lawmaking is a kind of communication process. Communication and participation of citizens for legislative proceedings not only help us to get over the present problems and to change the whole society actively, but also contribute to deliver knowledge and to express interest among citizens. In addition, they also play a role in boosting sense of responsibility of the concerned about legislation. Korea has a lot of institutional measures for legislative procedure to gather extensive opinions from various strata of society, and to vitalize participation of citizens. These processes are, however, used by the organizations which are to exercise legislative authority, and as processes for organizations, tend to understand the purpose of legislative procedure as information collecting. Therefore, individuals who submit opinions of information are expected to play only secondary roles, and because of organizations' leading role in beginning participation process, even if participants take part in the procedure, relying on organizations' decision in process beginning, they have nothing to do but remain passive. Consequently, we need to institutionalize an opinion collecting process on the legislative programming stage, which is similar to the institutions that Switzerland and the United Kingdoms have. And it is also important to make participation of the experts for the major bills draft and its information disclosure system compulsory. Furthermore, comprehensive reports which include various views of experts and stakeholders should be announced officially when it comes to readjustment of major laws. And then, consultation process gathering the general public's opinions to arrange final plans should be established. Lastly, It is necessary to reorganize the governmental portal site already constructed to an opinion-gathering portal, which will lead the contents to be 'documents to be seen' to 'documents can be used', and eventually to 'documents that we can make the best use of it'.

입법은 의사소통 과정이다. 입법절차에 대한 대국민 소통과 국민 참여는 현상태 의 극복과 사회의 적극적인 변화를 지향할 수 있고, 지식의 전달과 이익의 표출에 기여하며, 또한 참여의 주체들로 하여금 입법에 대한 책임의식을 높이는데 일조할 수 있다. 우리나라는 입법절차에서 국민의 다양한 의견을 수렴하고, 국민참여를 활성화하 기 위한 다수의 제도적 장치 마련하고 있는 국가이다. 다만 이들 절차는 입법권한 을 행사하는 기관이 그 권한행사를 위해 이용하는 절차이며, 기관을 위한 절차로서 입법절차의 목적을 정보수집으로 파악하려는 경향이 강하다. 때문에 의견이나 정보 제출하는 개개인은 절차에서 부차적인 역할밖에 기대되지 않고, 참여절차가 기관 주도로 개시되기 때문에 참가자가 하더라도 그 행사는 기관의 절차개시의 판단에 의존하기 때문에 소극적 지위에 머물 수 밖에 없다. 따라서 입법과정에서 보다 적 극적은 소통과 참여를 유도하기 위해 스위스나 영국처럼 입법계획단계에서의 의견 수렴절차를 제도화해야 하며, 주요법안에 대한 전문가 참여 및 공시제도를 의무화 해야 한다. 또한 주요 법령정비시 계획단계에서부터 전문가나 이해관계자들이 참여 하여 그들의 의견을 수렵한 종합적인 보고서를 공시하고 그에 대한 일반인의 의견 수렴을 통해 최종계획을 마련하는 협의제도를 신설해야 할 것이다. 마지막으로 현 재 구축되어 있는 정부입법추진 포털사이트를 개편하여 의견수렴절차에 관한 포털 사이트로서 ‘보는 문서’에서 ‘이용하는 문서’로, 나아가 ‘활용하는 문서’로 정착될 수 있도록 해야 할 것이다.
