Right to life is the comprehensive right for human life. That is, it is the right which can ask a country to protect right to life from invasion of others. When their lives are invaded from their country, all individuals can claim the exclusion and in addition, when their lives are invaded from other countries, they can ask for proactive protection to their country. As long as ‘right to life’ and ‘waiver of an aggressive war’ are guaranteed in the constitution like this, ‘right not to be a victim of an aggressive war’ can be interpreted as forming the most fundamental information of right to live in peace. That is, right to live in peace is the right not to be killed by an aggressive war or its preparation act caused by violations of the constitution of the country Article 5 and is the right that freedom is not violated. And if there is armed attack or illegal invasion from another country and as a result, people's lives, liberty is exposed to the risk of violation, the obligation of a country occurs to respond to it and the right not to be a victim of an aggressive war is the active right which asks for the protection of the people against the country if the country neglects it by political reasons. And ‘right not to be an attacker of an aggressive war–right not to be involved in aggressive war’ can be considered. The Constitution of the Republic of Korea Article 5 Clause 1 stipulates that the Republic of Korea shall endeavor to maintain international peace and shall renounce all aggressive wars and Clause 2 requires that the Armed Forces shall be charged with the sacred mission of national security and the defense of the land and their political neutrality shall be maintained. Since Article 5 Clause 1 stipulates that ‘renounce all aggressive wars’, ‘the mission of the Armed forces’ of clause 2 is limited to defensive war. Therefore, performing an aggressive war as well as ‘participating’ in an aggressive war can be considered unconstitutional.

평화적 생존권은 전쟁을 하지 않을 권리인가? 평화적 생존권이 전쟁을 하지 않을 권리인지 아닌지는 생 명권의 본질을 검토한 후 재고해 볼 문제이다. 평화적 생존권의 내용은 대한민국헌법의 해석상 ‘침략전쟁의 피해자가 되지 않을 권리’와 ‘침략전쟁의 가해자가 되지 않을 권리’가 될 것이라 판단된다. ‘침략전쟁의 피해 자가 되지 않을 권리’는 ‘생명권’에서 도출되지만 생명권이란 인간의 생명에 대한 포괄적 권리이다. 즉 생명 권은 타인의 침해로부터 생명권의 보호를 국가에 대하여 요구할 수 있는 보호청구권으로서의 성격뿐만 아 니라 국가의 침해를 방지하기 위한 ‘대국가적 방어권’으로서의 성격도 갖고 있다. 모든 개인은 ‘국가로부터’ 생명을 침해당할 때 그 배제를 청구할 수 있으며 뿐만 아니라 ‘타국으로부터’ 자신의 생명을 침해당하게 되 는 경우에도 국가에 의한 적극적인 보호를 청구할 수 있는 것이다. 이렇게 ‘생명권’과 ‘침략전쟁의 포기’가 헌 법적으로 보장되어 있는 한, ‘침략전쟁으로부터 생명을 침해당하지 않을 권리’는 평화적 생존권의 가장 근본 적인 내용을 이룬다고 해석할 수 있다. 이 ‘침략전쟁의 피해자가 되지 않을 권리’는 타국으로부터의 불법한 침략 또는 무력공격이 있고 그에 의해 국민의 생명, 자유가 침해되거나 침해의 위기에 처하게 된 경우, 먼저 그에 대응해야만 하는 국가의 의무가 발생한다는 것을 전제한다. 그리고 만약 국가가 이 의무에 위반하고 있다면 국민은 국가에 대하여 보호를 위한 ‘자위전쟁’까지도 요구할 수 있는 적극적인 권리이다. 이 논문은 생명권과 관련하여 평화적 생존권의 논의가 가장 활발하게 진행되고 있는 일본의 논의를 바탕으로 하여 대 한민국헌법상 인정될 수 있는 평화적 생존권의 특징을 주로 생명권의 관점에서 고찰하고자 한다.
