Act on the Performance of Duties by Police Officers defines the protection of people's health, life and property as the priority of the police's duties and recently violation of human rights and observance of due process due to the protection measures in police have been raised as social issues. The previous studies on protection measures in police were confined to discussing validity of protection measures, protection measures for non-recipients of emergency rescue and heavily drunken people, poor protection facility and management and limitation of compulsory measure of protection subjects. In addition, the studies on limitation and procedure according to legal property of protection measure on Act on the Performance of Duties by Police Officers, embodiment of protection measure subjects, security of principle of proportion on protection measure period, observance of due process and effectiveness of protection of rights are insufficient. Therefore, this study examined requirements, legal properties and procedures of the police according to Act on the Performance of Duties by Police Officers, reviewed legal problems such as validity and limitation of protection measures, the subjects of protection measures, stipulation of rescue agency, consolidation of punishment in case of refusal, security of due process and protection of human rights from protection measure and principle of proportion on period of protection measure and protection of rights for the victims from illegal or legal protection measure, suggested improvement methods of these problems, and aimed to make protection measure of the police prevent harm to people's health, life and property, guarantee human dignity and value on the Constitution and then realize the people's basic human rights.

경찰관직무집행법에서는 경찰의 직무범위중 국민의 신체, 생명 및 재산보호를 가장 으뜸의 직무로 규정하고 있는데, 최근 경찰상 보호조치로 인한 국민의 인권침해문제, 적법절차준수문제 등이 사회적 이슈가 되고 있다. 경찰상 보호조치에 대한 선행연구는 보호조치 정당성, 응급구호비대상자의 보호조치, 주취자 보호조치, 보호실의 열악성과 운영의 미흡성, 보호대상자의 강제처분의 한계등을 논의하는데 그치고 있으나, 경찰관 직무집행법상의 보호조치의 법적성질에 따른 한계와 절차, 보호조치 대상자의 구체화, 보호조치의 시간상 비례원칙 확보, 적법절차 준수, 권리구제의 실효성 등에 관하여 연구가 미흡한 상태이다. 따라서 경찰관직무집행법상 경찰관의 보호조치의 요건과 법적성질과 절차 등을 고찰한 후 보호조치의 정당성과 한계, 보호조치대상 구체화, 구호기관의 명문화와 거부시 벌칙강화, 보호조치에 따른 적법절차와 인권보호, 보호조치의 시간상 과잉금지, 위법․적법한 보호조치에 대한 피해를 입은 보호대상자에 대한 권리구제 등의 법적 문제를 검토하고 그 개선방안을 제시함으로써 경찰관의 보호조치에 의한 실효성 있는 국민의 신체와 생명․재산상의 위해를 방지하고, 헌법상 보장된 인간의 존엄과 가치가 보장되며, 국민의 기본권이 최대한 실현하고자 한다.
