Elder abuse and neglect is a social issue that violates the human rights, health and well-being of older people in most societies. Providing effective social services for abused persons has been a main concern across countries. While the majority of abuse cases are involved in family relationships, some occur in institutional settings. This paper argues that the distinction between filial abuse and institutional abuse, including client abuse, is necessary to develop appropriate strategies to prevent and tackle different types of elder mistreatment or maltreatment. Effective interventions in elder abuse and neglect in care facilities are particularly important as residents or other clients in care services may be more frail and vulnerable than the general population. As certain abuse and neglect cases are crimes, the issue around legal responses to the problem requires a collective effort at community and social levels. Some practical suggestions are provided.

노인에 대한 학대와 방임은 인간의 존엄과 권리를 침해하는 범죄 행위이며, 노인들의 건강과 행복을 위협하는 비인간적 폭력이다. 동서양을 막론하고, 노인 학대는 상당한 수의 노인 인구에 악영향을 미치는 사회적 문제로 대두되고 있다. 뉴질랜드에서도 노인 인구의 증가에 따라 노인 학대가 커다란 사회적 이슈가 되고 있으며, 이를 해결하고 예방하기 위한 사회적 및 형사법적 노력이 요청되는 실정이다. 노인 학대는 주로 가족관계 등 사적 영역의 문제로 인식되어 왔으나, 최근에는 요양 시설 등 전문 서비스 기관에서도 발생하는 것으로 보고되고 있다. 특히, 시설에서 발생하는 노인 학대는 가족 등 자발적 부양관계에서 발생하는 것보다 그 문제의 심각성이 높은 데, 이는 대부분의 시설 이용자가 사회적, 경제적으로 취약한 계층에 속하기 때문이다. 이 논문에서는 가족관계 등에서 일어나는 협의의 노인 학대와 노인부양기관 등에서 발생하는 시설 학대를 구분하고, 그에 대응하는 실천적 접근 방법을 제시하였다.
