Although “Cultural Industry Promotion Law” entered legislation plan early and it was listed in legislation which National eleventh five-year plan period cultural development plan outline is going to make, so far it has not entered the legislative process yet, which indicating there are some difficulties in legislation related to cultural industries; Clarifying these difficulties, unifying the ideological understanding and accelerating the legislative process of China's cultural industry are of great significance to the implementation of the 17th session of the Sixth Plenary Session of the Party spirit, the strength of cultural legal system construction , and the creation of a strong socialist country, This paper reviews the legislation overview of China's cultural industry, then proceeds with the analysis of a range of issues and the plight of China's cultural industry legislation, and finally puts forward a sound suggestion and approach, In the second 10 years of the new century, to explore this important theme for 2020, a new decade of China's cultural industry, will certainly help to push forward the prosperity and development of China's cultural industry, and promote the overall upgrade of China's comprehensive national strength.

중국 관련 기관이 <문화산업촉진법>의 입법 계획을 일찍 세워 <국가 “11.5” 계획 의 문화 발전 계획 개요>에 들어가며 급하게 제정해야 한다는 입법의 하나이지만 현재 입법조차까지 하지 않는다는 것이 문화산업의 입법이 문제점이 있어 보인다. 이런 문제점을 정리하여 대중의 인식을 통일하며, 중국의 문화산업의 입법을 촉진시 킨 것이 중국의 문화제도의 건설과 사회주의문화강국의 건설에 중요한 의미를 갖고 있다. 본 논문은 중국 문화산업입법의 현황을 정리하여 기존의 일련 문제점과 곤경을 분석하고 보완적으로 소견과 해결 방안을 제시한다. 21세기 제2번의 10년에, 2020년 을 직면한 중국문화산업의 새로운 10년의 주제를 논의함으로써 중국문화산업의 범영 과 발전을 추진시켜 중국의 종합적 국력을 인상시킬 수 있으리라 믿는다.
