The Korean Government has recently announced measures to strengthen the education that builds students’ character. It has also introduced teen courts as part of specific measures to address school violence. This study explores the possibility of using teen courts as a school-based violence prevention program through the analysis of two research papers that examined the effectiveness of teen courts, which have been implemented in the United States earlier than in South Korea. Based on the analysis and evaluation, this paper provides insight into the implications of teen courts for the solution to the school violence problem. Firstly, teen courts not only help the perpetrators of school violence to recognize the negative impacts of their behaviour on the victim, his family and the community, but also have positive educational effects for student participants of the program as a juror, judge, lawyer and so on. Secondly, teen courts can encourage healthy conversations between parents and children while working together in the program and experiencing positive behavioral change at the same time, and can also be helpful for the students to build good character. Finally, it has been found that teen courts can significantly reduce recidivism rates rather than having the perpetrators tried in juvenile courts.

최근 학교폭력문제가 심각해지면서 정부는 인성교육을 강조한 학교폭력종합대책을 발표한 바 있다.또한 학교폭력문제 해결을 위한 구체적인 방법 중 하나로 학생자치법정을 소개하기도 하였다. 이에 본 연구에서는 우리나라보다 앞서 시행하고 있는 미국의 청소년자치법정 효과를 분석한 두 편의 보고서를 통해 학교폭력 예방 프로그램으로서 학생자치법정의 활용 가능성을 살펴보았다. 이러한 고찰과 논의에 기초하여 학생자치법정의 학교폭력문제 해결에 대한 시사점들을 정리하면 다음과 같다. 학생자치법정은 가해 학생들이 가족과 피해자들, 공동체에 입히는 악영향을 인지하게 하는데 도움을 줄뿐만 아니라, 학생자치법정에 배심원이나, 판사, 변호사 등의 역할을 수행하는 자원 봉사학생들에게도 폭넓은 교육적 효과를 제공할 수 있다. 또한 학생자치법정은 가해 학생과 부모가 함께 참여하여 자녀의 긍정적인 행동 변화가 일어나는 과정을 함께 하면서 부모와 자식 간의 활발한 대화를 이끌고, 학생의 성격 형성에 도움을 줄 수 있다. 그리고 가해 학생들은 일반 소년재판을 받는 것보다는 학생자치법정 프로그램을 통해 재범의 가능성을 확연히 줄일 수 있다.
