The Seoul Metropolitan Office of Education for students of human rights ordinance has caused the active social debate and the sharp confrontation between the pros and cons. While the debate continues without reaching to conclusion, the Ministry of Education, Science and Technology took action as a response to make the ordinance of students human rights invalid. This situation led to the great confusion of each school which has to practically enforce the policy. Human rights of students stands for the general right and the special right as a student. The main issues of student rights ordinance are whether or not to allow corporal punishment, freedom of speech including the freedom of rallies and demonstrations, liberalizing dress and hair code and whether or not to allow the possession of mobile phones. The Issue of balancing the rights of students and teachers needs to be decided upon the national consensus after sufficient public discussion and debate. This phenomenon also comes from the gap between the school culture and the lifestyle of students. Thus, it is necessary to replace the school culture from controlling, bureaucratic and hierarchical school culture to the culture based on the enjoyable lifestyle with cooperation and sympathy. In addition, it is needed to apply human rights education to the regular curriculum and strengthen the educational activity for protecting student rights by implementing the school culture centralizing rational negotiation and compromise.

서울시교육청의 학생인권조례 제정을 계기로 찬반 양측이 첨예하게 대립하고 있다. 이에 교육과학기술부는 학생인권선언을 무효화하기 위한 조치를 취하였다. 이와 같은 상황은 학생을 지도하는 일선 학교에 혼란을 야기하고 있다. 학생인권은 불가양의권리와 학생 신분이라는 특수한 권리인 사회적 지위권을 의미한다. 학생인권조례의 쟁점은 체벌 허용 여부, 집회 및 시위 등 학생의 의사표현의 자유, 복장, 두발의 자유, 휴대전화 소지 허용 여부 등이다. 학생인권조례를 계기로 촉발된 학생 인권 존중과 교권 확보와의 대립 양상은 국민들의 충분한 논의와 여론 수렴을 거쳐 합의를 기반으로 결정될 과제이다. 또한 이러한 현상은 학교의 문화와 학생의 삶의 양식간의 격차에서 기인하는 것도 부인하지 못할 사실이다. 따라서 학교 문화를 통제 위주의 관료적, 계급적 문화에서협조와 공감 위주의 즐거운 생활 영위의 문화로 바꿀 필요가 있다. 아울러 합리적인 협상과 타협을 중시하는 학교문화를 정착하여 학생의 참여와 자율과 자치에 의한 학생인권을 보호하기 위한 규정을 제정하고, 정규 교육과정에서 인권교육을 강화할 필요가 있다.
