Legal system, private law relation and public law relation can be divided into aggregate building on the management. The "law" on "Act on the Ownership and Management of Aggregate Buildings" as a private law which is the foundation of the system, and public law relation is the "Housing Act". "Enforcement" by our legal system as a dual private law relation and public law relation, and has a legal system that the separation of ownership and management. In addition, the generation of a set of building small and large-scale generation of a set of building management system is different, and does not have provisions for the management of a complex set of buildings. "Enforcement" due to the conflict and conflicts inevitably occur. Therefore, it is reasonable to tentatively named "Act on the Mixed-use, Ownership and Management of Comunal Aggregate Buildings" Law Enforcement combines a special law as a kind of social law enacted looks.

한국의 집합건물관리에 관한 법체계는 사법상의 체계와 공법상의 체계로 구분할 수 있다. 그 체계의 근간을 이루는 법으로서 사법은 「집합건물의 소유 및 관리에 관한 법률」이고, 공법은 「주택법」이다. 이와 같이 우리의 법체계는 공·사법에 의한 이중적 관리법제이고, 소유와 관리를 분리하는 법체계를 갖고 있다. 또한, 소규모 세대의 집합건물과 대규모 세대의 집합건물관리체제가 다르며, 복합집합건물의 경우에는 관리에 대한 규정이 없다. 이로 인한 공·사법상의 충돌과 갈등이 필연적으로 발생하고 있다. 따라서 공·사법을 결합한 사회법의 일종인 특별법으로서 가칭「복합용도 및 단지집합건물의 관리에 관한 법률」을 제정할 필요가 있다.
