Democracy and Rule of Law has long been the basic principles of democratic states as well as the main subject of study in law-related and political education. Recently the correlational discussion of the two concepts - democracy and rule of law - has drawn the attention in 「Law & Politics」subject. This study has analyzed the meaning and principles of the two concepts in social studies textbook, and their relationship. The results of the analysis are as follows: First, the sequence of the school levels(from elementary to high) is necessary in the explanation of the concept and principles of democracy and the rule of law. As grades get higher, the textbook will take more improved approach in contents statement, ways of explaining, and the subject matter of study. Second, a clear division between similar concepts followed by detailed explanation will be readily intelligible to the learners. The division of concepts such as democracy & democratic government; constitutionalism & rule of law; formal & practical constitutionalism is presented in the textbook somewhat confusingly, which operates pressure for the learners. Third, plentiful examples at home and abroad related to democracy and rule of law should be presented in the textbooks, especially with the cases of foreign countries as well as the Korean society after 1997’s pro-democracy. Fourth, the complementary relationship between democracy and rule of law has been vaguely explained so far. Therefore, domestic and foreign learning materials should be developed to effectively explain their complementary as well as antagonistic relationship. Finally, in the ‘law and politics’ subject, the integrated approach to politics and law, that is, ‘legal culture & political culture,’ ‘the political & legal meaning of the constitution,’ and ‘international politics & law,’ is to be seriously in need of revision.

민주주의와 법치주의는 오랫동안 민주 국가의 기본원리로 작동했으며, 법과 정치교육의 주요연구 주제였다. 최근 ‘법과 정치’ 과목에 상호 관계 논의가 새롭게 도입되면서 관심을 받고 있다. 본 연구는 사회과 교과서 상에 민주주의와 법치주의의 원리 및 상호 관계를 분석하였다. 그 분석을 통해 얻은 시사점을 정리하면 다음과 같다. 우선 민주주의와 법치주의의 개념과 원리 설명에 있어 학교급 간 계열성 확보가 필요하다. 학교급 간 동일한 개념과 원리의 중복성과 지속성의 문제로 학습자 부담이 커지기 때문에 교과서는 내용 진술, 설명 방식, 학습 소재 면에서 심화된 접근 방식으로 진술되어야 한다. 둘째, 유사한 개념 간의 명확한 구분과 상세한 설명이 뒤따라야 학습자 이해도를 높일 수 있다. 민주주의와 민주정치, 법치주의와 입헌주의, 형식적 법치주의와 실질적 법치주의에 대한 개념 구분이 교과서 상에 다소 혼란스럽게 제시되어 학습자 부담으로 작용하였다. 셋째, 민주주의와 법치주의 관련 국내외 풍부한 사례를 교과서 상에 제시할 필요가 있다. 특히 외국 사례와 함께 1987년 민주화 운동 이후의 한국 사회와 관련된 적절한 사례 발굴 작업도 필요하다. 넷째, 민주주의와 법치주의의 상호 보완적 관계가 다소 막연하고, 당위적 수준에 머물고 있었다. 대립적 관계에 대한 보충 설명과 함께 상호 보완적 관계를 효과적으로 설명해 줄 수 있는 국내외 학습 자료도 개발·제시되어야 한다. 끝으로 ‘법과 정치’ 과목에서 정치와 법의 통합적 접근이 가능한 주제 즉 ‘법문화와 정치문화’, ‘헌법의 정치적 의의와 법적 의의’, ‘국제 정치와 국제법’의 상호 연계적 접근에 대한 진지한 후속 검토가 이루어져야 한다. 향후 민주주의와 법치주의의 개념과 원리, 관계에 관한 계열성 연구와 관련 개념의 학습자 이해도 조사, 민주주의와 법치주의의 상호 보완적 관계에 관한 적절한 사례 개발, ‘법과 정치’ 과목의 통합적 접근 실천 연구 등이 뒤따라야 한다.
