As it can be known from 2009 ITU ((International Telecommunication Union) statistics, Korea is a high-growing information society, taking 11th place in the world in internet users. On the other hand, due to adverse effects of the information society, juvenile game addiction problems and associated juvenile delinquency are recently becoming magnified as great social problems in Korea. In the midst of such circumstances, legal regulation measures [Youth Protection Act (Revised April 29, 2011) and laws regarding game industry promotion (Revised January 22, 2012)] which deal with systematic issues which game industries must modify in order to regulate juvenile game access and restrict user time are pouring out. However, such legal regulations cannot substantially regulate or restrain juvenile game addiction and various associated juvenile delinquencies. In other words, with regards to juvenile game addiction and juvenile delinquent actions associated with such addiction, analyses from a conventional regulatory standpoint and legal restriction are necessary, but an examination of therapeutic countermeasures within the legal regulation system such as analyses from a new neuro-scientific standpoint and the utilization of forensic psychiatric systems is even more so important and necessary. From this perspective, this text first I. Examines existing juvenile game addiction problems II. Of various countermeasures to the above, examines the content and effectiveness of legal countermeasures Next, III. After examining neuro-scientific diagnoses regarding juvenile game addiction, examines addiction concepts from a neuro-scientific standpoint and juvenile delinquent criminal responsibility problems based on this Ⅳ. Suggests the importance of a therapeutic justice approach regarding game addicted juvenile delinquent to supplement limitations to legal regulation measures regarding game.

인터넷 이용자수 세계 11위라는 ITU((International Telecommunication Union)의 2009년 통계에서 알 수 있듯이, 한국은 고도의 정보화 사회이다. 반면, 정보화 사회의 역기능으로 최근 청소년 게임중독의 문제와 그와 관련한 청소년의 비행이 한국의 커다란 사회적 문제로 부각되고 있다. 이러한 상황 가운데에서 청소년의 게임접속을 통제하고 그 이용시간을 제한하기 위해서 게임사업자들이 정비하여야 할 시스템적인 내용들이 주를 이루는 법률적 규제 방안들[청소년보호법(2011. 4. 29. 개정)과 게임산업진흥에 관한 법률(2012. 1. 22. 개정)]이 쏟아져 나오고 있는 실정이다. 그러나 그와 같은 법적 규제는 청소년의 게임중독과 그와 연관되어진 청소년의 각종 비행들을 실질적으로 통제하거나 억제할 수 없다. 즉, 청소년의 게임중독과 그 중독과 관련한 청소년의 범죄적 행위에 대해서는 종래의 규범적 관점에서의 분석과 법적 제재뿐만 아니라, 새로운 뇌 신경과학적 관점에서의 분석과 치료감호제도 등의 활용과 같은 법적 제재시스템 내에서의 치료적 대응방안 마련에 대한 검토가 더욱 중요하고 필요하다. 이러한 관점에서 이 글은 먼저, Ⅰ. 이러한 청소년 게임중독 문제의 현재를 살펴보고, Ⅱ. 그에 대한 각종 대응방안 중 법적 대응책들의 내용과 그 실효성에 대해 살펴본다. 다음으로, Ⅲ. 청소년 게임중독에 대한 뇌-신경과학적 진단을 살펴본 뒤, 뇌-신경과학적 관점에서의 중독개념과 그에 기초한 청소년의 형사책임능력 문제를 살펴보면서, Ⅳ. 게임중독에 대한 법률적 규제방안의 한계를 보완하기 위해 게임중독 범죄소년에 대한 법적-치료적 접근의 중요성을 제안하고자 한다.
