Since the enactment and enforcement of the Act on Contracts to Which a Local Government is a Party, the relevant contract dispute conciliation system seems to significantly contribute to resolving disputes involving contracts to which a local government is a party. However, such system does not seem to function effectively as a substitute dispute resolution method. Therefore, in order to have such system to function fully and efficiently, the author would like to review the current status of such system and its problems, to devise institutional and procedural methods to vitalize the system, and to conduct in-depth analysis of the system and review and present alternatives to such system for their utilization in dispute resolution procedures.

지방계약법이 제정, 시행되면서 지방계약분쟁조정제도 역시 지방계약법과 관련하여 발생한 분쟁을 해결하는데 상당한 기여를 하고 있다고 보이나, 소위 대체적 분쟁해결수단으로서 기능을 충분히 발휘하고 있다고 보기 어렵다. 따라서 지방계약분쟁조정제도가 그 본래적 기능을 발휘하기 위해서는 현재 분쟁조정제도의 현황과 문제점을 파악한 후, 분쟁조정제도를 활성활 수 있는 제도적·절차적 장치를 마련하고, 분쟁조정제도의 내용을 심도있게 분석하여 향후 분쟁조정에 활용하도록 그 대안을 검토하여 제시하고자 한다.
