UN Convention on Disability Rights is doing is a compass of obstacle relation policy of the various nations the place charging with the valuable guide, About the disabled person the policy from‘welfare’was converted with‘rights’had came the change of the paradigm which gives a duty in the nation. Disabled for the realization of human rights and efforts to improve social awareness of various financial and political support for reform, and attempts should be made in various dimensions. By the way, The government reserved the ratification of a part and of Optional Protocol. The disabled persons are bringing problematic strongly. UN Convention protects right of the disabled person and dignified and promotes is a general and integrated international treaty. The contents of convention with fundamental right of the Persons with Disabilities is relation. This agrees the fundamental right which our constitutions are providing. Increases the human rights and Fundamental rights of the Persons with Disabilities‘promotion’,‘protection ’and‘guarantee’ respects the dignity.

장애인권리협약은 각국의 장애관련 정책의 나침반이자 소중한 지침으로 자리매김하고 있으며, 장 애인에 대한 정책이‘복지’에서‘권리’로 전환되어 국가에게 의무를 부여하는 패러다임의 변화를 가지고 왔기에 장애인권리협약의 성안과 국내이행은 그 무엇보다도 중요하다. 장애인권리협약과 같은 인권법은 국가와 사회의 노력 없이는 그 실질적 실현이 매우 힘들다. 즉, 장애인의 인권실현은 잘못된 관습과 편견의 제거를 비롯해 제도 개선과 예산 지원을 통해 달성되어야 하는 만큼 그 실현이 쉽지 않을 뿐만 아니라 사회적으로도 익숙하지 않다. 따라서 장애인 인권실현에 대한 노력은 사회 인식개선 과 각종의 제도개혁 그리고 재정적 및 정책적 지원 등 다양한 차원에서 시도되어야 하며, 장애인권리 협약 이행에 대한 다양한 차원에서의 감시와 평가 없이는 그 실질적인 실현을 담보하기 어렵다. 그런 데 정부가 장애인권리협약의 일부와 선택의정서의 비준을 유보하여 장애인들이 강하게 문제제기를 하 고 있는 상태이다. 장애인권리협약은 장애인의 권리와 존엄을 보호하고 촉진하기 위한 총체적, 통합적 국제조약으로 우리나라 헌법 제6조 제1항에 의거하여 국내법과 같은 효력을 가지게 된다. 이러한 장애 인권리협약의 내용을 보았을 때, 협약의 내용은 장애인의 기본권과 관련이 있으며 이것은 곧 우리나라 헌법이 규정하고 있는 기본권과 맥을 같이 하고 있다. 따라서 이에 대한 유보철회와 선택의정서의 비 준동의안이 빠른 시일 내에 국회에 제출되어야 할 것이며, 이는 장애인의 인권과 기본적 자유를 증 진·보호·보장하고 장애인의 고유한 존엄성을 존중하는 데에 큰 역할을 할 것으로 보인다.
