Lately, we are witnessing overt acts of disobedience to the constitution and nation occurring under the name of democracy and human rights. The present social tendency can destroy the nation established on the constitution and Korea's future seems to be dim. Constitution, stipulation of the fundamental laws of the state, was the product of the human spirit that unyoked the Hellenistic human value and nature from the sorcerous 1000 years of the Middle Ages and enlightened it with freedom. This invention of the modern ages of the West has now become the universal asset for the human race. ‘Establishing a constitution’ has the same meaning as ‘to build a nation.’ It is because a nation is its constitution in the legal form. Thus, the first constitution is also called the ‘nation founding constitution.’ As we established the first constitution in 1948, we were able to have a nation called the Republic of Korea and that nation brought us common stability by delivering governance based on the constitution and laws. One abides by the constitution as s/he upholds his/her nation. The rule of law, constitutionalism and constitutional state are the words directed to the rulers. They are not words that can be the base to agitate common people. We should note that abstract words intended to replace the constitution such as “the spirit of the age”, “the national group” and “national unification” are against the principle of law and constitution. We will witness uprooting of the national foundation unless we accept that only those nations supported by the full-fledged constitutional spirit can grow strong and only then, civil rights and interests can be protected.

대한민국헌법이 있음으로써 자유민주주의를 기본 이념으로 하는 근대의 국가인 대한민 국이 탄생되었다. 그 대한민국은 우리들에게 헌법과 법에 의한 통치와 지배를 행하여 대 한민국 국민들에게 공동체적 안정성을 줄 수 있었다. 그런데 대한민국의 정통 세력이 좌 파와 치열하게 투쟁하여 얻은 시장경제와 법제도가 지금 또 다른 도전을 받고 있다. 반 사 회계약적 정의의 관념들이 진정한 정의인 양 사회정의, 사회연대라는 추상적인 가치를 앞 세워서 사람들의 자유로운 행동의 자유를 침해하는 등, 신판 전제주의 사회로 가고 있다. 이를 막는 유일한 길은 정부가 자유주의 법제도와 시장경제를 존중하는 헌법을 지키는 일 이다. 우리 헌법은 정치적으로는 자유민주주의, 경제적으로는 자유시장경제라는 두 가지 이념을 추구한다. 이러한 이념을 달성하기 위한 수단으로써 헌법은 의회주의, 사법권 독 립 등의 여러 헌법원칙 중에서도 적법절차를 핵심으로 하는 법치주의를 채택하고 있다. 즉 대한민국헌법이 천명하는 목표·이상·원리·원칙은 자유민주주의․시장경제체제로 집약 된다. 이는 우리 헌법뿐만 아니라 인류보편의 가치라고 볼 수 있다. 권위주의와 가난에 시 달렸었지만, 대한민국 건국 이래 우리는 우리 헌법의 목표․이상․원리․원칙을 견지했지 한 번도 이를 저버리지 않았다. 자유주의적 법치와 헌법주의라는 대한민국의 헌법적 가치 와 질서가 우리 사회의 정신적 구심점이 되어야 한다. 그것은 예종의 길이 아닌 자유의 길 로 우리들을 이끌 것이다.
