The title of this thesis is " A Study on the Land Ownership System in premodern Korean Society". Land ownership system is not something that is being newly developed but is a system which has evolved along with the history of mankind, a thorough examination of past social system can lead to a future social system that is more rational and accords with substantial justice. The land system in the Chosun Dynasty is focus more the sovereignty of the monarch and the heredity of absolute power rather than the land ownership of the individual. Therefore, the land system in the Chosun Dynasty is different from the modern land system made to protect the rights of individuals.

이 논문의 제목은 전근대 한국사회의 토지소유제도에 관한 고찰이라고 정하였다. 토지소유제도는 새롭게 창출되는 제도가 아니고, 인류의 역사와 함께 발전되어 온 제도이다. 따라서 종래의 토지소유제도의 운용모습을 면밀하게 분석한다면, 장래에 정립될 토지소유제도는 보다 합리적이고 실질적 정의에 합치될 수 있다고 생각한다. 이와 관련하여 전근대 한국사회 특히 조선시대의 토지소유제도는 근대법상의 토지소유제도와 많은 부분에서 차이가 있다. 즉 당시의 토지소유제도는 개인의 토지소유권의 보호에 초점을 두고 운용되었다기 보다는, 왕토사상을 중심으로 하여 절대적 권력을 향유하고 있었던 군주의 주권강화와 이러한 절대권력의 세습 자체에 초점을 두고 운용되었다고 볼 수 있다. 이러한 점에서 전근대 한국사회의 토지소유제도는 개인의 권리를 제도적으로 보호하고 있는 근대적 토지소유제도와는 상당한 차이가 있다.
