대다수의 아파트 관리규약에서는 전소유자가 체납한 관리비는 경락인 등의 특정승계인에게 승계하도록 규제하고 있는데, 문제가 되는 것은 공동주택의 관리비가 체납된 상태에서 그 공동주택을 승계한 특정인에게 체납관리비에 대한 납부 책임을 물을 수 있는가이다. 판례는 이에 대해 특정 승계인은 체납관리비 중 공용부분 관리비만 특정 승계인이 납부할 책임이 있다고 하였다. 따라서 이하에서는 공용부분과 전용부분이 함께 승계된다는 견해를 중심으로 다툼이 된 부분의 학설, 판례를 살펴보고, 공시제도의 미비로, 관리비의 채무가 없음을 믿고 거래한 제3자에게 불측의 손해가 생길 수 있는 점을 착안하여, 이를 보완하고자 연체관리비 채권에 관한 집합건물 관리비 공시증서 교부, 개별관리비 열람시스템을 중심으로 입법적 개선 방안을 모색한다.
