The railroad is utilized as a important traffic means of modern society. For public peace on related railroad, there are several organization as railroad special judicial police attached to Korail. Special Judicial Police have characters of speciality, urgency, the preservation of public security, and isolation, and the Railroad Special Judicial Police is a field to apply isolation hard to reach the right of criminal investigation of General Judicial Police. The Railroad Special Judicial Police achieve more a role of administrative police than judicial police. In the past time of The National Railroad Administration, it is reasonable to accomplish that the public servant of government perform to maintain public peace and order in the area of railroad and the inside of the train, but these days, for Korail, that is Korea Railroad Corporation show up a public enterprise, it makes consideration with a view point of balance because there are many public corporation in Korea, which corporation may not demand to offer public peace service for national institution. The railroad special judicial police is operated to base a Criminal Procedure Code and the law of person and duty extent for judicial policeman, that is judicial police but they play an active part in administrative police such as control of the criminal of administrative law and the prevention of crimes. The railroad special judicial police, subway police team, order maintenance team as petition police, it is desirable to cooperate each other, however it is not problem to solve easily.

철도는 현대 사회에서 중요한 교통수단의 하나로 이용되고 있다. 철도와 관련된 치안의 유지를 위해서 한국철도공사내의 철도구간에서 국토해양부 소속의 철도특별사법경찰이 치안을 담당하고 있다. 특별사법경찰은 전문성, 긴급성, 보안성, 격리성 등의 성질을 고려하여 운영되고 있는데 철도 특별사법경찰은 일반 사법경찰의 수사권이 미치기 힘든 장소적 격리성의 특성이 적용되는 영역이다. 철도 특별사법경찰은 범죄수사와 관련된 사법경찰의 역할보다 범죄예방과 관련된 행정경찰의 역할을 중점적으로 수행하고 있다. 철도특별사법경찰은 「형사소송법」과 「사법경찰관리의직무를행할자와그직무범위에관한법률」에 근거하여 운영되고 있는 사법경찰이지만, 실제 활동은 행정범 단속과 범죄예방에 주력하고 있는 행정경찰의 모습을 보여주고 있다. 과거 국가기관인 철도청 소속이었을 때에는 국가에서 공무원으로 하여금 치안유지 업무를 수행하는 것이 적절한 것으로 인정되었으나, 공기업의 형태를 띤 한국철도공사에 대해서 국가에서 치안을 지원하는 것은 형평성 차원에서 고려해 볼 여지가 있다. 2012년 기준으로 300여개가 넘는 공기업에서 자체적인 치안을 국가기관에 요구하는 선례가 될 수도 있다. 철도특별사법경찰을 경찰청 소속의 경찰공무원으로 통합하는 문제, 철도특별사법경찰의 확대 개편 등의 대안이 있을 수 있고, 공기업인 한국철도공사에서는 철도산업에 민간 기업이 관여하는 미래를 대비하여 자체적인 치안유지 인력을 양성하여 활용할 필요가 있다.
