Loss often occurs between international trading parties in international trade. Trade disputes commonly arise because of the loss that occurs between the parties. Therefore, the matter of when the risk is transferred from the buyer to the seller is an important part toward trade disputes. The parties frequently adopt the Incoterms® 2010 rules and the CISG in international trade. This paper has compared and analyzed the two regulations named Incoterms® 2010 rules which took effect on January 1, 2011 and the CISG in regards to the transfer of risks and summed up the differences between the two regulations. Indications as to place or destination can helpfully be further specified by stating a precise point in order to avoid doubt or argument.

국제무역거래에서 당사자의 책임이 없는 위험으로 인하여 손해가 발생하는 경우가 많다. 이러 한 위험으로 인하여 무역 분쟁이 흔히 발생한다. 따라서 “위험이전시기”문제는 무역 분쟁 중 중요 한 부분을 차지하여 왔다. 국제무역거래에서 당사자들이 흔히 채택하는 무역법규는 바로 Incoterms와 CISG이다. Incoterms와 CISG는 위험이전에 있어 대체적으로 일치하지만, 반드시 동일한 것은 아니다. 여기서 본고는 2011년 1월 1일에 발효된 Incoterms® 2010상의 각 조건별 위험이전 및 CISG상의 위험이전 내용을 분석함으로써 두 법규의 차이점을 정리하였다. 두 법규를 사용하는 무역당사자들은 본고에서 검토할 내용을 명확히 이해함으로써 무역거래에서 발생할지도 모르는 분쟁을 사전에 예방할 수 있을 것으로 기대한다.
