Environmental pollution liability insurance is a new kind of insurance. Because of continuous occurrence of environmental pollution accidents and the rise of environmental consciousness of the public, China's environmental pollution liability insurance is an urgent need to improve. In the theoretical background of China's environmental insurance, there are switch to the collective liability of environmental pollution, the realization of sustainable development concept, the realization of harmonious social stability. In the debate of Chinese environmental insurance, there are the randomness of insurance entrance, narrow liability coverage, small indemnification rate etc. Through the literature of China, China's environmental legislation and its related law are studied and suggested. And the direction and strategy for the development of environmental insurance are proposed for reference.

환경오염 책임보험은 일종의 신형보험이다. 환경오염 사고의 지속적인 발생과 대중의 환경의식의 대두로 인해, 중국의 환경오염 책임보험제도는 시급한 개선을 요구하고 있다. 중국의 환경보험의 이론적 배경에는 환경오염의 공동책임으로 전환, 지속가능한 발전이념의 실현, 조화로운 사회 안정의 실현보장에서 출발하였다. 또한 실무적 배경에는 기업의 경영안정 유지, 기업의 환경 책임 실천, 중국정부의 환경감독 강화 등에서 출발하였다. 중국에서 환경보험의 논쟁에는 가입여부의 임의성, 책임범위의 협소화, 보상비율의 과소화, 보험요율의 과대화 등이 존재한다. 중국의 문헌을 통해 중국의 환경보험법 및 관련 법률의 제정과 방향을 고찰하며, 환경보험의 발전에 대한 전략들을 정리한다. 또한 중국시장에 진출하고자 하는 기업들에게 중국의 환경보험에 대한 사전지식을 제공하여 국제무역거래에 도움을 제공하고자 한다.
