As a means of compensation for territory ownership limitation and the system which enables the trade of floor area ratio which cannot be used by the territory ownership limitation having a same purpose of the transferable development rights, the research has discussed on the selection method of purchase and transfer region, the floor area ratio trading means, distribution cost formation of floor area ratio trading and has analyzed the inducement direction and legislative justification of floor area ratio trading based on the main point of policy discussion and literature research on the floor area ratio trading. In case of Floor area ratio trading, rather than a deprivation of property rights on the territory, by developing over the set density to give the Floor area ratio to developer, purchasing the Floor area ratio to others, having the shares of newly constructed building's share and allowing share holder's to purchase to others, the point that it enables to exercise by the means to purchase the rights on the Floor area ratio that the territory retains will obtain the public understanding.

본 연구는 토지소유권 제한에 따른 보상 방안으로 개발권양도제와 기본취지가 같은 용적률거래제의 도입과 정착방안에 관하여 연구하였다. 용적률거래제는 토지소유권 제한으로 인해 사용하지 못하는 용적률을 거래하는 것으로 문헌연구와 정책토론회에서 나타난 쟁점을 중심으로 용적률거래제 도입방향과 법적 타당성을 검토한다. 그리고 양도 ․ 매입지역의 선정방법, 용적률 거래방법, 용적률거래제의 유통가격형성에 대해 논한다. 용적률의 권리를 판매라는 방법으로 행사할 수 있다는 점이 국민들의 이해를 얻을 수 있는 것이다.
