This essay raises a question why the public seriously distrust public authorities including the state concerning their will and capability to settle public disputes. This study finds out that the authorities cause the distrust by unreasonably giving priorities on publicness against privateness and ignoring commonness, and that the distrust makes their actions lose support from the public. This research traces back to the theory of the nation sovereignty and related constitutional dialogues during the French Revolution to investigate the origins of the public distrust. And this paper also explores some desirable and harmonious ways to reorganize 'privateness,' 'commonness,' and 'publicness' to provide institutional devices to generate publicness in 21 century's Korean society.

이 연구는 공공성(公共性)을 대표하는 국가를 비롯한 공적 권위체들이 왜 공적(公的) 문제를 처리할 의지나 능력에 대해 극도의 불신을 받는가라는 질문을 던져 보고, 그 원인을 사회 일반의 공동성(commonness)을 외면한 채 사익(私益)에 대립하는 공공성(publicness)만을 강조하면서도, 그에 근거한 공적(公的) 행위조차도 제대로 그 정당성을 인정받지 못하는 현실에서 찾는다. 그리고 그러한 현실을 초래한 원인을 근대 시민국가를 지배하는 이데올로기인 국민주권이론과 그와 관련된 헌법담론으로부터 찾아내고자 한다. 프랑스 혁명과정에서의 근대적 개인관의 역할과 주권이론의 허구성을 논한 뒤, 주권, 공동성, 공공성 개념의 관계에 대해서 살펴보며 공동성에 기반을 둔 공공성 창출 방안을 모색해 보았다.
