The domestic cosmetics regulation related to quality control are different from global regulation, showing that the cosmetics regulation are not free from Pharmaceutical regulations. Although the Cosmetic Law has been separated from the Pharmaceutical Law, the regulations that shipment of finished products is allowed when its quality test results meet the specifications have not reflected the individuality of the cosmetic industry, which features small quantity batch production and holds sensual quality in high regard. The paper sets forth suggestions for improving quality control regulation to increase the competitiveness of the Korean cosmetic industry, which is in stronger international competition due to the FTA, through comparative study of advanced countries’ regulations.

화장품법에서 규제하고 있는 우리나라 화장품의 품질관리 제도는 약사법의 그늘을 채 벗어내지 못한 듯 국제적인 규제환경과 사뭇 다르다. 화장품의 산업적 특성을 반영하고자 화장품법으로 독립하였음에도 정해진 화장품의 기준 및 시험방법에 따라 롯트별로 시험검사하여 합격품에 대해서만 출하가 가능하도록 규제하고 있는 것은 다품종 소량생산의 산업적 특성과 감성적 품질을 더 중요시하는 화장품의 특성을 제대로 반영하지 못하고 있다. 본 논문에서는 화장품 산업 선진국의 규제환경의 비교 분석을 통해 FTA 등 점점 더 국제적인 경쟁체제 속에 놓일 국내 화장품 산업의 경쟁력을 높일 수 있는 품질 관리제도를 제안하고자 한다.
