테러리즘(terrorism)의 위협은 인권․빈곤 문제등과 함께 오늘날 국제사회가 직면하고 있는 가장 심각한 인보문제로서 주목을 받고 있다. 즉 최근 들어서 ‘세계 인보환경의 특징은 국가간 전면전의 가능성은 줄었으나 테러, 대량살상무기 확산 등 초국가적, 비군사적위협이 증대되었고, 잠재되었던 갈등요인들이 표면화 되면서 국가안보에 대한 위협의 성격이 다양하고 복잡하게 되고 있다. 특히 2001년의 9.11테러 이후 테러는 특정지역의 문제가 아닌 전 세계적인 공포의 대상이 됨에 따라, 테러방지 역시 어느 한 국가만의 문제가 아닌 전 인류의 문제가 되고 있다. 이에 따라 UN을 비롯한 국제사회는 테러방지를 위한 국제협약을 체결하여 각국으로 하여금 법적․제도적 장치를 강구하도록 권고하고 상당수의 나라는 다양한 대응책을 마련시행하고 있다. 우리나라 역시 이에 동참하기 위해 반 테러 관련 법제의 제정을 추진하고 있으나 여야 및 일부시민 단체 등 관련 기관간의 입장차이로 인해 지금까지 입법이 실현되지 못하고 있다. 본고와 관련해서는 찬성과 반대 2가지 입장차이가 있다. 따라서 찬성논자 입장에서 우리나라에서 반테러 관련법의 제정 필요성을 검토하고 걸림돌이 무엇인지에 대해 나름대로 대안을 제시하고자 한다. 중점된 주장으로는 첫째 테러방지법 제정이 지금처럼 입법이 어려우면 차라리 미국의 대 테러 대책법인 애국법(patriot act)처럼 한시법으로 가자는 것이다. 둘째로는 대테러기능을 통합하고 조정․기회 업무를 담당할 가칭 ‘테러방지청’을 국가 정보원 등 특정기관 산하에 두지 않고 별도 기구로 만들자는 주장이다. 향후 우리나라의 반테러관련입법과 정책에 기초자료를 제공하고자 하는 데 그 목적이 있다. 동시에 반테러 관련법제의 오․남용 우려나 문제점, 현행법 체계와의 중복 및 헌법에 배치되는 각종 사항들의 장점에 대해서도 고찰 해보고자 한다.
