Although moral subject education has played roles as a core subject for moral tradition education and democratic citizenship education in our society, the status of it has been weakened rather than being strengthened in each time for revising the national curriculum and it has suffered from being neglected. What’s even more regretful is that after the Contention in June, 1987 when our society began to lay the foundation for civil society, they have criticized moral subject education even more severely and constantly. The core of this criticism against that moral subject education is neither that it is impossible to realize ideal character in reality such as the Buddhist saint or man of virtue nor that citizens having rational and critical self-interest based on law observance cannot solve various moral issues today. The core of the criticism is that citizenship education or political education in the moral subject education has not been freed from authoritative political power, and as a result, the subject consists of contents supporting anticommunist education and the authoritative autocratic system, and this has a great gap with the democratic citizenship education demanded by the civil society in which each individual’s freedom, right, responsibility, and duty should be harmonized symmetrically with the nation. Thereupon, this article sees as the cause of the risk in moral subject education that has continued the retrogression or inconsistency of democratic, civil society in moral subject education affected by political power. And it aims to grope for directions to improve and develop moral subject’s civil education through the constitution prescribing the values and norms of our civil society as a means to take charge of desirable democratic, civil education demanded by the civil society and maintain moral subject education that can be firm despite the changeful political power.

도덕과교육은 우리 사회의 도덕적 전통 교육과 민주시민교육의 중핵적 교과로서 역할을 담당해 오고 있음에도 불구하고, 도덕과교육의 위상은 교육과정의 개정시기 때마다 강화되기 보다는 약화, 홀대되는 수모를 당하고 있다. 안타까운 것은 1987년 6월 항쟁이후, 즉 우리 사회가 본격적으로 시민 사회의 토대를 마련한 이후의 도덕과교육에 대한 비판이 더욱 강하고, 지속적으로 나타나는 실정이다. 이러한 도덕과교육의 비판의 핵심은, 보살이나 군자와 같은 이상적 인간상이 현실적으로 불가능하다는 비판도 아니며, 준법성을 전제로 한 합리적이며 비판적 타산성을 지닌 시민으로는 오늘날의 다양한 도덕 문제를 해결할 수 없다는 비판도 아니다. 비판의 핵심은 도덕과교육에서의 시민교육 혹은 정치교육이 권위주의 정치권력으로부터 자유롭지 못하였고, 그 결과 반공교육과 권위주의 독재 체제를 옹호하는 교과내용으로 구성된 점에서 비롯되었고, 이는 개인의 자유, 권리와 책임과 의무가 국가와 대칭적 조화를 이뤄야 한다는 시민사회가 요구하는 민주시민교육과는 큰 괴리가 있는 데 있다. 이에 본 논문에서는 지속되어 온 도덕과교육의 위기의 원인을 정치 권력에 따른 도덕과교육에서의 민주시민사회의 역행 혹은 비일관성으로 보고, 시민사회가 요구하는 바람직한 민주시민교육을 담당하면서도 정치권력의 변화에도 흔들림 없는 도덕과교육이 되기 위한 방안으로 우리 시민사회의 가치 규범을 규정하는 헌법을 통하여 도덕과 시민교육의 개선 및 발전 방향에 대해서 모색해 보고자 한다.
