In Korea, domestic long stay foreign population are rapidly increasing by international marriage and foreign labor for an aging society and low birthrates.
In the age of globalization, people who have many kinds of nationalities can marry and should enjoy various rights and happiness. However, female marriage immigrants who get married to Korean male have produced many problems. Especially, female marriage immigrants in the underdeveloped country are under multiple human rights abuse by compounding Korean racial discrimination, class distinction and sexual discrimination. To solve these problems, government pushes for many policies for protecting female marriage immigrants with enacting Framework Act on Treatment of Foreigners Residing in the Republic of Korea or Multicultural Families Support Act. However, policy paradigm which clarifies multicultural society still preserves existing order of society and shows fundamental critical point centering around the unification of female marriage immigrants' mainstream society.
This study examines many problems brought centering around female immigrants' legal position and them through Korean's marriage and tries to show the direction of proper legal protection about it.

우리나라의 경우 국내 노동시장의 환경변화와 저출산 고령화 사회로 인한 외국 노동력의 증가, 국제결혼 증가로 인한 결혼 이민자 수의 증가 등 국내 장기 체류 외국인의 수는 급격히 증가하고 있다.
세계화 시대에 다양한 국적의 사람들이 결혼을 하고, 또 다양한 권리와 행복을 누릴 수 있어야 한다. 그러나 한국남성과 결혼한 이주여성은 많은 문제를 낳고 있다. 특히 저개발국의 국제결혼 이주여성은 한국인의 인종차별과 계급차별, 성차별이 복합되어 다중적인 인권침해를 받고 있다. 이런 문제점을 해결하기 위하여 정부는 재한외국인처우기본법이나 다문화가족지원법 등을 제정하여 결혼이주여성을 보호하기 위한 각종 정책을 추진 중이다. 그러나 다문화사회를 규명하는 정책패러다임은 여전히 기존의 사회질서를 유지하면서 결혼이주여성의 주류사회 통합을 중심으로 동화주의에 입각하는 형식적인 성격이 다분하여 근본적인 한계점을 보여주고 있다.
이에 본 논문에서는 대한민국 국민과의 결혼을 통하여 유입된 이주여성의 법적 지위와 그들을 중심으로 야기 되는 여러 문제점들을 검토하고 이에 대한 적절한 법적보호의 방향을 제시하고자 한다.
