In Germany responsibility for the education system is determined by the federal structure of the state. Under the Basic Law (Grundgesetz) the exercise of governmental powers and the fulfillment of governmental responsibility is incumbent upon the individual states(Länder) as far as the Basic Law does not provide for or allow for any other arrangement.
The German education system is divided into pre-school education, primary education, secondary education, tertiary(higher) education and quaternary(continuing) education.
Sources of the German education law are the German Constitution(Basic Law) and the constitutions of the states, legal bases of (early) childhood education and care, school laws, higher education laws, vocational education and training laws, adult education and further education law, multimedia and law.
In the German education law system, fundamental changes are currently being implemented under which special importance is attached to the various efforts for more autonomy and quality assurance.
The federal reform in Germany transferred legislative powers in education from the Federation to the States. Is the educational reform trending toward the autonomy of school in the further development of the German education law system? For the answer we should watch the evolution of the German school laws and higher education laws.

12세기 무렵 길드에 의해 조직된 마이스터수업부터 시작되었다고 할 수 있는 독일의 교육제도는 취학전교육영역, 제1단계영역(초등교육), 제2단계(중등교육), 제3단계(고등교육), 제4단계(평생교육), 특수교육 그리고 사립학교 및 사립대학 영역으로 편제되어 있다.
그리고 교육법의 법원 및 분류는 기본법 및 주헌법, 아동 및 청소년 관련법, 학교법, 대학법, 직업교육법, 성인교육법, 멀티미디어 및 정보화 관련법 등으로 나누어 편제되어 있다고 할 수 있다.
유럽연합으로의 발전과 세계화의 흐름 속에서 독일 교육법제의 진화 방향은 앞으로도 학교 및 대학교의 자율성, 다양성 및 책임성을 확대하는 방향으로 계속 나아갈 것으로 전망된다. 이런 독일의 노력이 새로운 가치지향적 교육문화의 창출로 이어질지의 여부를 관심 있게 고찰해 보는 것이 우리의 교육법제 발전 및 연구에도 반드시 필요한 작업이라 사료된다.
