Historically, discretion has been studied at the individual level of analysis. This is particularly the case in the literature on policing, which provides an important counter to the widely held assumption by some scholars that police officers rather unproblematically and uniformly translate law-on-the-books into action. Several decades of research on policing demonstrates that law enforcement does not work this way. In the world of policing, however, discretion is not merely a characteristic of individual action, subject to the particularities of an officer's personality and background. Rather, discretion also has collective and contextual dimensions; thus it should be analyzed at both the individual and aggregate levels. Police administrators are aware that individual officer's discretion contributes to a lack of uniformity in policing, so administrators routinely orient to organizational policies as a crucial point of intervention, a vehicle for standardizing police officer behavior through structural change, executive orders, and the adoption of formal departmental policies. Especially, I suggest to use police code of conduct as well as executive orders for autonomous stanardization of policing. It is most effective way to control of police discretion because of reducing of resistance and defiance by external control. I think that "The Code of Conduct" by U.N. and International Police Chiefs can be modelled to adapt Korean Police Code of Conduct to control police discretion effectively.

역사적으로 경찰재량은 개인적 차원에서 분석의 대상이 되어왔으며 학자들은 경찰관이 경찰조치를 취함에 있어서 법령을 법 그대로 적용하는데 별 문제가 없는 것으로 가정해 왔지만 사실은 그렇지 않다. 경찰재량의 행사는 개인적 차원에서 경찰관의 개성과 배경에 따라 특성이 달라지기도 하고 집단적 차원에서 조직문화에 따라 달라질 수도 있으므로 경찰재량은 집합적 차원에서도 검토되어야 한다. 관리자들은 경찰재량 행사가 경찰활동의 통일성을 저해한다는 점을 인식하고 중요사항에 대해 공식지침을 제정한다든가 재량준칙을 설정하고 조직구조를 변경하는 등 개별 경찰관의 행동을 표준화시키기 위한 조치를 취해왔다. 경찰재량을 적절히 통제하기 위해 재량준칙과 행동강령 등, 자율규범에 의한 통제방안을 특별히 검토할 필요가 있다. 자율규범에 의한 통제는 외부적 타율규범에 의한 통제와 달리 비교적 거부감 없이 받아들여질 수 있기 때문이다. 경찰재량 통제를 위한 자율규범의 대표적 사례로 유엔의 법집행관행동강령과 국제경찰장협회가 제안한 경찰관행동강령을 참고할 수 있으며, 우리나라에 적합한 경찰행동강령이 조속히 제정되어 효과적인 경찰재량 통제에 기여할 수 있기를 바란다.
