Organized crime has become a world phenomenon and is accompanied by the business climate, corrupted officials, economic situations and so on. Even though organized crime used to be well regarded as organized violence crime in Korea, organized crime may include traditional activities such as prostitution, the arm trade, drug trafficking, the additional money laundering and so on. In this research, organized crime refers to a crime activity by organized group. Mostly, organized crime may understand and explain themselves with tendency of getting mafia-type organized crimes. Notably, it became clear that organized crime activities in recent time have a different criteria than the traditional crime.　 In addition, a strong international cooperation will be needed to solve the problem of transnational organised crime. Furthermore, a discussion on the present legislative countermeasure against the organized crime and the improvement should be made in accordance with this chapter and the future study.

조직범죄란 일정한 조직체계와 내부규율을 가지고 경제적 이익추구의 목적과 불법적 수단으로 영속적이고 계획적으로 형사법 위반행위를 하는 범죄라고 할 수 있다. 마피아, 야쿠자, 삼합회 등 우리나라에서도 그와 같은 유사하는 특징을 가지는 조직범죄가 존재하고 있다. 우리나라의 경우 범죄조직은 서민상대로 갈취하거나 유흥업소에서 활동함에 더 나아가서 합법적인 사업체를 가장하여 기업조직 형태도 변모하고 있다. 그리고 국제화․개방화되어 가고 있어 국제범죄조직과 연계하여 그 활동범위가 넓고, 그 범죄수법도 다양하고 전문화되고 있다. 조직범죄에 효율적으로 대처하기 위하여 전담수사반을 설치하여 적극 활용하거나 감청․잠입수사 등의 수사기법도 제한적으로 활용되어야 할 것이다. 입법론적으로 미국 등과 같이 조직범죄규제법을 제정하기 위하여 조직범죄의 심각성과 법제정의 당위성이 전제되어야 할 것이다. 앞으로 조직범죄에 대한 발생원인, 특성 등에 대한 지속적인 실태연구와 더불어 이에 대응한 효율적인 수사 및 법적 규제가 이루어져야 한다.
