EU applies different risk assessment procedures and criteria according to the uses of GMOs, that is, contained use of GMMs, deliberate release of GMOs into environment(including commercial and non-commercial release), GM food and feed, and transboundary movement of GMOs. Accordingly, EU has five unique GMOs-related Directives and Regulations, which include Directive 2009/41/EC on the contained use of generically modified micro-organisms; Directive 2001/18/EC on the deliberate release into the environment of genetically modified organisms and repealing Council Directive 90/220/EEC; Regulation 1829/2003 on genetically modified food and feed; Regulation (EC) No 1946/2003 on transboundary movements of genetically modified organisms; Regulation 1830/2003 concerning the traceability and labelling of genetically modified organisms and the traceability of food and feed products from genetically modified organisms and amending Directive 2001/18/EC. Directive 2009/41/EC on the contained use of generically modified micro-organisms lays down common measures for the contained use of genetically modified micro-organisms with a view to protecting human health and the environment. ‘Contained use' means any activity in which micro-organisms are genetically modified or in which such GMMs are cultured, stored, transported, destroyed, disposed of or used in any other way, and for which specific containment measures are used to limit their contact with, and to provide a high level of safety for, the general population and the environment. Directive 2001/18/EC on the deliberate release into the environment of genetically modified organisms and repealing Council Directive 90/220/EEC applies to any intentional introduction into the environment of a GMO or a combination of GMOs for which no specific containment measures are used to limit their contact with and to provide a high level of safety for the general population and the environment. Regulation on genetically modified food and feed applies to
genetically modified food and feed and containing or consisting of GMOs.

유럽연합의 경우는 용도에 따라, 즉 밀폐사용 유전자변형미생물에 관한 Directive 2009/41/EC, GMO의 의도적 환경방출에 관한 Directive 2001/18/EC, 유전자변형 식품과 사료에 관한 Regulation (EC) No
1829/2003, 적용 법률을 달리하고 있다. 우리나라와 미국의 GMO 규제법과 특별히 달리 하는 것은 유전자변형 식품과 사료에 대해 특별한 표시와 이력추적에 관한 법률(즉 Regulation (EC) No 1830/2003)을 제정하고 있다는 것이고, 유럽연합 공동체의 자격으로 바이오안전성의정서에 가입함에 따라 유럽연합 공동체 영역내에서 이동하는 법률과 유럽공동체에서 다른 당사국 이나 제3국으로 이동하는 GMO에 대해서는 별도의 적용법률(Regulation (EC) No 1946/2003)을 제정하고 있고, 이 때에도 유전자변형생물체의 용도에 따라 각기 다른 기준들을 적용하고 있다는 특징을 보이고 있다. Directive 2009/41/EC on the contained use of generically modified micro-organisms은 유전자변형미생물(genetically odified microorganisms (GMMs)의 밀폐 사용을 규제한다. 동 지침은 사람이나 환경과의 접촉이 없는 밀폐 상태에서 유전자변형 바이러스나 박테리아와 같은 유전자변형미생물을 연구용으로 또는 산업용으로 작업하는 행위를 규제한다. Directive 2001/18/EC는 GMO의 의도적 환경방출을 규제하는데, GMO를 시험적으로 환경방출하는 행위와 GMO를 산업용 상품으로 재배(cultivation), 수입 또는 변형transformation)하여 상업용으로 판매 유통하는 행위를 규제한다. Regulation (EC) No 1829/2003은 유전자변형 식품과 사료(genetically modified food and feed) 또는 GMO 함유 또는 구성 식품과 사료의 판매유통을 규제한다. Regulation (EC) No 1830/2003은 GMO의 표시와 이력추적(traceability), 그리고 유전자변형 식품과 사료의 이력추적에 대해 규정하고 있다. GMO가 유럽연합으로부터 제3국으로 이동하는 경우에 유럽연합은 바이오안전성의정서의 당사국으로서 동 의정서의 이행법률이라고 할 수 있는 Regulation (EC) No 1946/2003을 채택하였다. Regulation (EC) No 1946/2003 은 유럽연합 회원국과 비회원국간 GMO의 의도적 그리고 비의도적 이동에 대해 규정하고 있다. 그러나 유럽연합 회원국간의 공동체 영역 내의 의도적 이동에 대해서는 적용대상에서 제외하고 있다.
