This paper inquires into various opinions on justificatory grounds of civil disobedience and tries to reveal their problems. R. Dworkin insists that civil disobedience is to be justified on the ground of constitution. His viewpoint is contradictory in that civil disobedience is not legal but illegal. H. D. Thoreau insists that civil disobedience is to be justified on the ground of individual conscience. His viewpoint is not proper in that it can not get universal justification by arbitrary judgement. J. Rawls insists that civil disobedience is to be justified on the ground of the commonly shared sense of justice or the principles of justice. His viewpoint is not proper in that it does not permit to criticize the existing conception of justice or the existing sense of justice. P. Singer insists that civil disobedience is to be justified on the ground of the principle of utility. His viewpoint is not proper in that it is difficult to calculate the profit and loss of individual situation. J. Habermas insists that civil disobedience is to be justified on the ground of formal principle of morality such as communicative rationality. His viewpoint is not proper in that it does not propose material principle of morality and does not make a contribution to solving practical problems. Civil disobedience is ought to be comprehensive to the extent that it is permissive to criticize constitution as such and to be justified on the ground of moral justification. Moral justification ought not to be justified not on the ground of the existing public conception of justice or the commonly shared sense of justice. It is ought to be comprehensive to the extent that it is permissive to criticize the existing public conception of justice. The action to be warranted as justificatory action in the modern democratic society is to have universal justification by the way of democratic procedure. We ought to try to propose material principle of morality for civil disobedience.

이 논문은 시민불복종의 정당화 근거에 대한 다양한 입장들을 살펴보면서 그 문제점을 지적하려고 한다. 드워킨은 헌법에 의거하여 시민불복종의 정당성을 주장하는데 이러한 입장은 헌법에의 합치성, 즉 합법성을 근거로 하고 있다는 점에서 위법성을 특징으로 하는 시민불복종 개념에 비추어 볼 때 자기 모순적이다. 또한 도덕적 정당성의 관점에서 헌법 자체를 문제 삼을 수 없다는 한계를 지닌다. 소로우는 개인의 양심에 의한 정당화를 주장하는데, 이러한 입장은 이러한 입장은 자의적인 판단으로 인해 보편성을 확보하기 어렵다는 문제점을 갖고 있다. 롤즈는 공유된 정의감이나 정의의 원칙을 근거로 시민불복종을 정당화하고 있는데 이러한 입장은 기존의 정의관이나 정의감에 대한 비판을 허용하지 않는 등 시민불복종의 범위를 제한하는 문제점을 갖고 있다. 싱어는 공리의 원칙에 의거하여 정당성을 주장하는데 이러한 입장은 개별적인 상황에 따라 이익과 손실을 계산해야 하는 어려움이 따른다. 하버마스는 롤즈나 싱어와는 다르게 의사소통적 합리성과 같은 형식적인 도덕 원칙에 근거하여 시민불복종의 정당성을 주장하는데, 이러한 입장은 실질적인 도덕 원칙을 제시하지 않음으로써 실제적인 문제 해결에 도움이 되지 못하고 시민들에게 판단의 부담을 떠넘기는 문제가 있다. 시민불복종은 헌법 자체도 문제 삼을 수 있도록 포괄적이어야 하며, 이를 위해서는 합법성이 아니라 도덕적 정당성에 근거해야 한다. 그리고 도덕적 정당성은 기존의 공적인 정의관이나 공유된 정의감에만 근거해야 하는 것은 아니며 그러한 기존의 다수의 정의관에 대해서도 문제를 제기할 수 있을 정도로 포괄적이어야 한다. 또한 근대 민주주의 사회에서는 행위의 정당성을 주장하기 위해서는 민주적인 절차를 통해 보편성을 확보해야 하며 더 나아가 시민불복종을 위한 실질적인 도덕적 원칙을 제시하려고 시도해야 한다.
