The current trend of devolution in Germany gives the traditional debate on centralisation-decentralisation and Inter-Governmental Relations(IGR) a new momentum and quality. Changed environments raise again the old question of local authority and fiscal federalism: which distribution of responsibilities conforms with the 'Subsidiaritaetsprinzip'(principle of subsidiarity) and is in balance with the distribution of revenue and expenditure capacities? In a legal perspective, there are three guiding principles which define pre-requisites for real intergovernmental partnerships and their accountability: autonomy, legality and subsidiarity. The focus of this study will be solely on intergovernmental relations and IGM/IGP(Inter-Governmental Management/Inter-Governmental Partnerships) in German local authority. In Germany, different levels of governments many conclude agreements with each other which are judicially enforceable Inhe autonomy and accountability in German local authority focused Staatsaufsicl (States control) and Finanzkontrolle(finacial control). So far, 'performance partnerships' between levels of governments are still treated as exceptions in the legal framework. As intergovernmental performance partnerships in Germany become more common, the legal framework will have to be changed accordingly.

지방자치가 발전 정착될수록 권한이나 재정을 둘러싼 지방자치단체의 욕구는 더욱 커질 수밖에 없다. 절대적인 재원부족현상을 보이고 있는 독일 같은 현대 후기복지국가에서 비효율적인 국가작용에 따른 낭비나 유용은 가장 심각한 문제 로 지적되고 있다. 이로부터 정부간 관계, 특히 중앙과 지방간의 갈등이 갈수록 심화되고 있다. 이 때문에 일찍이 지방자치 선진국에서는 자치단체의 권한과 재정을 둘러싼 합리적인 정부간 관계를 정립하기 위해 노력해 왔다. 이론적으로는 지방자치 하에서는 물론 연방국가에서도 전체 국가에서를 위한 정부간관계론 (IGR)이 발전 되었으며, 지방재정조정제도나 공동세제도 같은 재정합리화 방안 이 적용 발전되어 온 것이다. 본 논문은 지방자치단체의 권한을 둘러 싼 독일의 정부간 관계(중앙-지방정부간관계) 사례에 대한 비교분석을 통하여 한국에의 정책적 시사점을 모색해 보는데 연구목적을 둔다.
