Security Industry Act is a basic Korean act of private security industry to regulate activities and operation of businessmen, instructors and workers in security. This act puts its purposes on contributing to sound operation of security industry by determining what is required to nurture, develop and systematically manage it. The purpose of this study is to see main issues on revising「Security Industry Act」and to present ways to activate private security industry. Ways to revise main issues of Security Industry Act are following. Firstly, enlarging the range of security industry is required. Although security industry grows annually in its quantity, it is focused on guarding facilities in service and on Seoul and Gyeonggi-do in location. Considering that advanced nations get the security industry diversified and detailed, Korea also should enlarge it by introducing private investigation, traffic security and private army security services. Enlarged security work would lead to further growth and highly contribute to making companies advanced and specialized by globalizing it, as well as to economic boom. Secondly, all the troubles in the contract must be improved. Overheated competition and lowest-price contract would weaken security industries and fall off its service quality it if kept going on, which makes it hard to expect development and sound operation of security industry. Therefore, the facility owners must change their recognition, and legal revision such as limiting sub-contract must be discussed. Thirdly, regulations about security instructors must be revised. Job training and re-training system must be prepared, and quality and standards for education and career of Security Instructor Test must by revised. Fourthly, training regulations about security workers must be revised. Problems in system must be made up for by post-education, and the educational program to fit 5 sections of security service (facilities security, escort, body guard, mechanical guard, and special security service) must be re-organized. Fifthly,「Security Industry Act」and「Security Guard Act」must be integrated. The gaps between those two acts should be narrowed by either preparing a bill to integrate both acts, or revising those acts.

「경비업법」은 경비업자, 경비지도사 및 경비원의 활동과 운영을 규제하고 있는 한국 민간경비산업의 기본법이다. 이 법은 경비업의 육성 및 발전과 그 체계적 관리에 관하여 필요한 사항을 정함으로써 경비업의 건전한 운영에 이바지함을 목적으로 하고 있다. 본 연구에서는 이러한「경비업법」 개정에 대한 현안을 쟁점별로 살펴보고, 민간경비산업의 활성화를 위한 개정방안을 제시하고자 하였다. 경비업법 개정의 주요쟁점에 대한 개정방안은 다음과 같다. 첫째, 경비업에 있어서 경비업무범위의 확대가 요구된다. 경비업체가 매년 양적 성장을 하고 있으나, 경비업무에 있어서는 시설경비업무에 편중되어 있고, 지역적으로는 서울․경기지역에 편중되어 활성화되고 있다. 또한 선진국에서 경비업무영역을 다양화하고 세분화하고 있음을 주목하여 민간조사업, 교통유도경비, 민간군사경비업 등과 같은 경비업무의 확대를 검토해야 한다. 경비업무가 확대된다면 더 큰 성장을 이끌어 낼 수 있을 것이며, 경기부양은 물론 기업의 글로벌화를 꾀할 수 있어 선진화 및 전문화에 큰 기여를 할 수 있을 것이다. 둘째, 도급 계약상의 제문제를 개선해야 한다. 과당경쟁 및 최저가 도급계약이 지속된다면 경비업체는 부실해지고 경비서비스의 품질이 저하될 것이며 경비업의 육성과 건전한 운영은 기대하기 어렵다. 따라서 시설주의 인식변화도 필요하며, 하도급의 제한 등 법적 개선과제도 논의되어야 할 것이다. 셋째, 경비지도사에 관한 규정들을 개정해야 한다. 경비지도사에 대한 직무교육 및 재교육 제도를 만들어야 하고, 국가시험인 경비지도사 시험의 자격기준, 교육 규정, 경력기준 등을 고려하여 개정해야 한다. 넷째, 경비원 교육훈련에 관한 규정을 개정해야 한다. 경비원에 대한 사후교육과 같은 제도적 문제점을 보완하고, 교육프로그램은 5개 경비업무의 특성에 맞게 재구성해야 한다. 마지막으로, 「경비업법」과 「청원경찰법」의 통합이 요구된다. 양 법의 통합법안을 마련하거나, 「경비업법」의 개정을 통하여 격차를 줄여나가야 할 것이다.
