The purpose of the study is to find a reasonable way of deliberation with reviewing the Internet Election News Deliberation on the legal and institutional aspect and researching the possible problems on the deliberation of the unfair election news caused by the unique characters of the Internet News. The study at first examined the problems of internet news deliberation system with reviewing the concept and scope of internet newspaper, the issue of IENDC(Internet Election News Deliberation Commission)'s position, and the normative role of internet newspaper in our society. Also, the article critically examined about relations between the internet newspaper's unique characters and actual application of election law. The study shows that the unique characters of the internet news media are mixed with the characters of mass media, and personal communication. Especially we need to see internet news deliberation from different angle than in the traditional way, because of the news form and interactivity of internet newspaper. According to these characters, we have to execute the regulations about the internet news media carefully. And this suggests that we have to consider the internet media is ‘the media to promote the expression’, when we enact the regulations about the internet.

이 연구의 목적은 인터넷 선거보도 심의와 관련한 법제에 대해 살펴보고 기존 매체와는 다른 인터넷언론의 특성 때문에 심의 시 발생할 수 있는 문제점과 제한점들을 검토하여 매체의 특성을 고려한 합리적인 심의방안을 찾는데 있다. 이 연구는 먼저 제도적 차원에서 인터넷언론사의 개념과 범위, 인터넷선거보도심의위원회의 소속문제, 그리고 공정성의 개념과 인터넷언론의 규범적 역할에 대한 고찰을 통해 심의제도와 운용상의 문제점 등에 대해 검토한다. 또한 보다 미시적인 차원에서 인터넷언론의 특성으로 인해 발생하는 관련 공선법 및 심의기준의 실제 적용 문제에 관해 비판적으로 살펴본다. 분석에 따르면 인터넷매체는 대중매체적 속성과 개인 커뮤니케이션적 특성이 혼재되어 있는 매체로서, 관련법의 적용이 매우 섬세하고 조심스럽게 이루어져야 할 필요가 있음이 제시되었다. 특히 인터넷언론의 독특한 뉴스형식이나 상호작용성 등과 같은 매체적속성은 기존의 대중매체와는 다른 방법으로 불공정성의 심의가 이루어져야하는 근거가 되고 있다. 이는 최근 가시화되고 있는 인터넷관련 규제법과 제도의 운영이 ‘표현촉진적’매체로서 인터넷의 속성을 잘 살리는 방향으로 신중하게 이루어져야할 필요가 있음을 시사한다.
