The main goal of this article is to scrutinize some grounds on which Hegel’s political philosophy can be interpreted as a synthetical theory of the liberties of the ancients and the liberties of the moderns. To actualize this goal, I dealt with the viewpoint of human beings of liberalism and the main features of modern liberty developed by Thomas Hobbes and John Locke by contrast with the theory of liberties of the ancients at the first section. At the second section I dealt with Hegel’s crucial criticism about theories of social contract developed by Thomas Hobbes, John Locke, J.-J. Rousseau and I. Kant. According to Hegel’s criticism theorists of modern social contract confuse civil society with state. This confusion is closely related to the individualism of modern society and liberties of individuals, which the theorists of social contract protect. Finally, I attempted to make clear some reasons why Hegel criticizes market-oriented modern society as the institutional manifestation of the individualism and it is necessary to sublate market society by the state in oder to demonstrate main goal of this article in the concrete context.

우리는 이 글에서 헤겔의 정치철학이 어떤 점에서 고대인의 자유와 근대인의 자유를 종합하는 이론인지를 검토할 것이다. 우선 홉스 및 로크를 통해서 제시된 자유주의적 인간관 및 근대적 자유의 특성을 고대의 자유관과의 대비 속에서 살펴본다. 특히 여기에서는 자치로서의 자유와 간섭의 배제로서의 자유에 대한 서로 상이한 견해가 설명된다. 이어서 다루어지는 주제는 헤겔의 사회계약론 비판이다. 특히 홉스, 로크 그리고 칸트 등에 의해서 전개된 사회계약론이 시민사회와 국가를 혼동하고 있다는 헤겔의 비판을 중심으로 근대에서 등장한 이상적 사회상의 모습이 지니는 문제점을 살펴볼 것이다. 이를 통해 우리는 왜 근대적 개인주의가 자체적으로 해결할 수 없는 딜레마 속에 빠지게 되는가를 보다 분명하게 인식하게 될 것이다. 마지막으로 근대 개인주의의 제도적 표현인 시장 지향적 사회의 내적인 논리를 통해 근대성의 위기의 구체적인 모습인 경제적 불평등에 대한 헤겔의 입장을 다룰 것이다.
