The purpose of this study is to describe developmental aspects of school-based law-related education(LRE) before and after the enactment of LRE Support Act in Korea. In order to achieve the purpose of this study, I started analyzing characteristics of excellent LRE programs in America. Then, I examined the historical backgrounds of school-based LRE in Korea. Finally, I investigated the current state of school-based LRE in Korea. The major results from this study are as follows. First, excellent LRE programs, as a result of a grassroots movement, focus on learning about street laws and legal concepts, include active learning with participation and action, promote the incorporation of law-related instruction in the existing curriculum, use outside resource persons, and provide teachers with continuing in-services. Second, the backgrounds of school-based LRE in Korea are based on the continued concerns of teachers on law studies, the separation of LRE from the political education, and the influences of American LRE. Third, school-based LRE in Korea is in two ways: traditional school-based LRE by the public schools, and school-based LRE by the Ministry of Justice. The former is pursuing street laws and students?participation, but it is negative about using outside resource persons and providing teachers with continuing in-services. The latter complies with characteristics of excellent LRE programs, but it is centered on the extra-curricular activities. In conclusion, through establishing a complementary relationship between traditional school-based LRE and school-based LRE by the Ministry of Justice, we must seek systematic methods for supporting LRE in the classrooms.

본 연구의 목적은 법교육지원법 제정을 계기로 한국의 학교 법교육의 전개 양상을 살펴보는 것이다. 이를 위하여 성공적인 법교육을 정착시켜 온 미국 학교 법교육의 대표적인 유형이 갖는 특징을 살펴보고, 한국 학교 법교육의 개괄적인 등장 배경을 검토하며, 미국의 학교 법교육 유형이 주는 특징적인 시사점에 터하여 한국 학교 법교육의 전개 양상을 분석해 보았다. 본 연구의 결과는 다음과 같다. 첫째, 미국의 학교 법교육은 풀뿌리 운동으로서 생활법과 법 개념, 학생의 적극적인 참여와 행동, 학교 교육과정에의 통합, 지역사회 인적자원의 활용, 지속적인 교사연수를 지향한다. 둘째, 한국 학교 법교육은 법에 대한 현장 교사들의 지속적인 관심, 정치교육으로부터 법교육의 분리, 미국 법교육의 영향으로 형성된 것이었다. 셋째, 한국의 학교 법교육의 전개 양상은 전통적으로 교과 활동 중심으로 생활법과 학생들의 참여와 행동을 지향하고 있으나, 지역사회자원 활용과 교사 연수가 미미하였다. 그리고 법무부의 학교 법교육은 생활법과 학생의 행동과 참여를 통한 법교육을 실행하고자 하며, 교재와 연계된 지속적인 연수를 하고 있으나, 비교과활동 중심의 학교 법교육을 전개하고 있었다. 이제는 전통적인 학교 법교육과 법무부의 학교 법교육의 관련성을 학교 현장을 중심으로 보다 면밀하게 분석하여 두 법교육의 상보적 관계를 설정하여 체계적인 실천이 모색되어야 할 시점에 이르렀다고 본다.
