독일의 중증장애인 고용정책 : 그 의미와 시사점 - 사회법전 제9권을 중심으로 -
Employment Policies of Disabled People in Germany : Significance and Suggestion : with Focus on Social Security Code Ⅸ
The purpose of this paper is to analyze german employment policies of disabled people and to provide significant support and advice for its disability policy in Korea. Social Security Code Ⅸ was established in 2001, brought together different legislation and involved a programmatic transformation in official German disability policy which went from the welfare approach to equal participation. This comprehensive law provides the basic framework concerning all regulations about the rehabilitation and equal participation of disabled people in Germany. In the field of the employment of disabled people the German government mainly relies on traditional instruments. There is a quota system that requires all private companies and public services with 20 employees or more to have at least 5% severely disabled staff. In the case of non-compliance employers have to pay compensation tax which is collected and used in turn to finance accessible workplaces as well as special employment and job programmes. All employers, who offer jobs and/or training for people with disabilities, can get public funding and information as well as consultation by special advice bureaus, the so called Integration Services(Integrationsämter), which have the task to assist in the employment of disabled persons, for example by financing measures of accessibility and technical adaptations, subsidizing wages and personal assistance at the work place etc. The most important actors in the field of creating accessible jobs are local Integration Offices(Integrationsfachdienste). Their aim is to help people with severe disabilities who have special difficulties finding regular employment by way of applying active promotion measures. Generally, social legislation obliges all employers to consider if a free job could be given to a severely disabled applicant. In the case of job terminations employees with severe disabilities have special protection. Private business and civil service both are also obliged to employ ombudspersons who represent the interests of disabled staff as well as applicants.

본 연구의 목적은 중증장애인을 대상으로 한 독일의 장애인고용정책에 대해 분석하고 이를 통해 한국의 장애인 고용정책에 주는 시사점을 도출하는 것이다. 독일의 장애인고용정책은 2001년 산재되어 있었던 장애인 관련법들을 「사회법전 제9권」에 통합 법전화하며 체계화하게 된다. 「사회법전 제9권」의 입법목적은 중증장애인의 “재활과 참여”, 즉 중증장애인의 노동관계를 강화하고 노동시장에서의 불이익을 제거하자는데 있다. 이러한 법적 안정성에 기초하여 일반노동시장의 진입이 특히 어려운 중증장애인들이 의무와 보호고용의 기회 및 고용관계를 유지할 수 있는 권리를 갖게 되었다. 독일의 중증장애인 5%의 의무고용제도와 차별금지제도 뿐만 아니라, 특히 통합사무소와 통합전문가의 역할은 중증장애인의 직업재활과 노동시장참여를 제도적으로 보장하는데 핵심적인 역할을 하고 있다. 나아가 장애인의 권익보호 및 해고보호를 위한 통합사무소와 중증장애인대표의 역할은 장애인의 완전한 사회통합을 위해 우리에게 주는 시사점이 크다.
